En arbetsmiljö är både fysisk och psykosocial. Den fysiska delen är enkel att överblicka eftersom den är objektiv, medan den psykosociala är lite mer komplicerad då den är subjektiv och personer uppfattar den olika. I uppsatsen utreds begreppet psykosocial arbetsmiljö för att ge en förståelse för dess innebörd och relevans till ämnet. Kränkande särbehandling är det begrepp som används i svensk rätt och därför utreds dess innebörd närmare. Mobbning visar sig ha likställts med kränkande särbehandling i mycket forskning men de skillnader som har hittats presenteras också. I uppsatsen utreds begreppet psykosocial arbetsmiljö för att ge en förståelse för dess innebörd och relevans till ämnet. Kränkande särbehandling är det begrepp som används i svensk rätt och därför utreds dess innebörd närmare. Mobbning visar sig ha likställts med kränkande särbehandling i mycket forskning men de skillnader som har hittats presenteras också. I uppsatsen görs ingen skillnad mellan begreppens innebörd eftersom mobbning alltid innebär kränkande särbehandling. Beteendet utgörs av negativa handlingar som riktas mot någon under en längre tid. Den utsatte personen ställs utanför en social gemenskap och det skapar en stor förvirring och ett trauma. Kränkande särbehandling kan få allvarliga konsekvenser för den som drabbas. Arbetsmiljölagen är den huvudsakliga lagstiftningen på området och den ålägger arbetsgivaren ett stort ansvar för att skapa en god arbetsmiljö där arbetstagarnas hälsa skyddas. Lagen ger dock ingen möjlighet för den enskilde arbetstagaren att föra en rättslig process emot arbetsgivaren. I en mobbningssituation kan även annan lagstiftning bli aktuell. I uppsatsen redogörs för diskrimineringsrätten, anställningsskyddet och straffrätten för att utreda hur dessa områden påverkar den enskildes rättigheter och skyldigheter. Trakasserier kan omfattas av diskrimineringslagen om den grundar sig i någon av diskrimineringsgrunderna som lagen ställer upp eller om det är ett fall av sexuella trakasserier. Det visar sig att diskrimineringslagen erbjuder ett starkare skydd än arbetsmiljölagen och att kränkande särbehandling därför kan få olika utfall beroende på vilket uttryck beteendet tar. Den som mobbar en kollega riskerar att bli omplacerad, uppsagd eller avskedad om det går att styrka att beteendet inneburit ett brott mot anställningsavtalet. Alla arbetstagare ska enligt arbetsmiljölagen medverka till en god arbetsmiljö. (Less)

The physical part is easy to overlook because it is objective, while the psychosocial is a bit more complicated since it is subjective and people perceive the differently. In the essay the concept of psychosocial work environment is examined in order to provide an understanding of its meaning and relevance to the subject. Victimization is the concept used in Swedish law and therefore its meaning is closer examined. Bullying proves to be equalized with victimization in much research but the differences found is also presented. The physical part is easy to overlook because it is objective, while the psychosocial is a bit more complicated since it is subjective and people perceive the differently. In the essay the concept of psychosocial work environment is examined in order to provide an understanding of its meaning and relevance to the subject. Victimization is the concept used in Swedish law and therefore its meaning is closer examined. Bullying proves to be equalized with victimization in much research but the differences found is also presented. In the essay there makes no distinction between the meaning of the two concepts since bullying always entails victimization. The behaviour consists of negative actions directed against someone for a longer period of time. The exposed person is put outside of a social community and it creates a great confusion and a trauma. Victimization can have serious consequences for the person affected. The Work Environment Act is the main legislation in the area and it imposes a wide responsibility on the employer to create a good working environment where the health of the workers is protected. The law however does not give the individual any possibilities to take legal actions against an employer. In a situation of bullying there is also other legislation that can become relevant. In the essay there is given account for the Discrimination Act, the Employment Protection Act and the Penal Code in order to examine how these areas affects the rights and obligations of the individual. Harassment can be covered by the Discrimination Act if it based on any of the grounds for discrimination laid down by the law or if it is a case of sexual harassment. It appears that the Discrimination Act offer a stronger protection than the Work Environment Act and that victimization can therefore have different outcomes depending on the type of behaviour that takes place. Anyone bullying a colleague risks getting repositioned, laid off or dismissed, if it can be proved that the behaviour has meant a breach of the employment contract. All workers shall contribute to a good working environment according to the Work Environmental Act. (Less)
