Inom ramen för svensk straffprocessrätt tillåts användande av flertalet olika tvångsmedel. Tvångsmedlet häktning regleras i 24 kap. RB och kan under vissa förutsättningar kombineras med restriktioner. Inskränkningar i den enskildes privata sfär är emellertid inte helt okontroversiellt och resulterar i motstående intressen. Sveriges tillämpning av häktning i kombination med restriktioner har under en längre tid mötts av omfattande kritik. Det har bl.a. framhållits att Sverige har långa häktningstider varav en stor del av de häktade underkastas restriktioner och att det saknas tillfredsställande motivering vid användning av dessa restriktioner.

RB och kan under vissa förutsättningar kombineras med restriktioner. Inskränkningar i den enskildes privata sfär är emellertid inte helt okontroversiellt och resulterar i motstående intressen. Sveriges tillämpning av häktning i kombination med restriktioner har under en längre tid mötts av omfattande kritik. Det har bl.a. framhållits att Sverige har långa häktningstider varav en stor del av de häktade underkastas restriktioner och att det saknas tillfredsställande motivering vid användning av dessa restriktioner.

I en komparativ jämförelse med dansk rätt framgår bl.a. att Danmark har en anmälningsplikt till högre åklagare vid isolering av den häktade utöver åtta veckor samt tidsgränser för hur länge någon får sitta häktad. Svensk åklagarmyndighet har förhållit sig positivt inställd till en liknande anmälningsplikt men negativt inställd till maxtidsgränser.

Rapporter visar att långa häktningstider under restriktioner kan bero på t.ex. hög arbetsbelastning hos NFC eller bristfällig kommunikation mellan NFC och beställare. Framtagen statistik, vilken granskats med stor försiktighet, påvisar att Danmark trots den stora skillnaden i åläggande av restriktioner kan uppvisa en klart högre uppklarningsprocent än Sverige.

Resultatet av utredningen visar att en begränsning av användandet av restriktioner i form av lag inte nödvändigtvis medför önskad effekt, utan att det kan finnas ett större syfte med att identifiera grundproblematiken bakom de långa häktestiderna. (Less)

Within the framework of Swedish criminal procedure, the use of several different enforcement measures is permitted. Forced detention in the form of comittal is regulated in Chapter 24 RB and may under certain conditions be combined with restrictions. However, restrictions impose a violation on the private sphere of the individual and are not completely uncontroversial which results in opposing interests. Sweden's application of comittal in combination with restrictions has been widely criticized for a long time. Among other things, it has been emphasized that Sweden has long-term comittal, of which a large proportion of the detainees are subject to restrictions and that there is no satisfactory justification for using these restrictions.

In a comparative comparison with Danish law, it appear that Denmark has a duty to report to a higher prosecutor if the isolation of the detainee excess of eight weeks as well as time limits for how long someone may be held under comittal. The Swedish Public Prosecutor's Office has expressed a positive attitude towards a similar reporting obligation but negatively to the maximum time limits.

Reports show that long-term comittal under restrictions may be due to, for example, high workload at NFC or inadequate communication between NFC and clients. Produced statistics, which have been examined with great caution, show that, despite the large difference in the imposition of restrictions, Denmark shows a much higher conviction rate than Sweden.

The result of the investigation shows that limiting the use of restrictions in the form of laws does not necessarily produce the desired effect, but there may be a greater purpose in identifying the basic problems behind the long-term comittal. (Less)
