Abstract (Swedish)
Denna uppsats syftar till att utreda den mest fundamentala frågan inom rättsvetenskapen, nämligen hur har rätten legitimerats genom historien och hur legitimeras den idag? Uppsatsen undersöker hur dessa frågor har besvarats av olika tänkare under olika tidsåldrar. Den börjar med att undersöka de antika filosoferna och arbetar sig sedan framåt genom historien. Till en börjar var teokratismen dominerande, vilken innebar att normerna ansågs givna av en godomlig makt. Därefter lanserades teorier vilka gick ut på att vi människor med hjälp av vårt förnuft kunde sluta oss till vissa normer genom resonemang, naturrätten. Denna uppsats syftar till att utreda den mest fundamentala frågan inom rättsvetenskapen, nämligen hur har rätten legitimerats genom historien och hur legitimeras den idag? Uppsatsen undersöker hur dessa frågor har besvarats av olika tänkare under olika tidsåldrar. Den börjar med att undersöka de antika filosoferna och arbetar sig sedan framåt genom historien. Allteftersom började även dessa idéer ifrågasättas då de hävdades utgå från att vi kan bilda oss en vetenskaplig uppfattning kring sådant som vi inte kan göra vetenskapliga experiment kring. Detta ledde fram till de rättspositivistiska åskådningarna som kan anses dominera rättsvetenskapen idag. I analysen kommer vissa av kärnfrågorna att analyseras mer djupgående och förhoppningsvis tillhandahålla resonemang som kan anses vara intressanta för den fortsatta utvecklingen. Denna analys kommer ta fasta på de argument som tidigare framförts och utgå från tidigare teoribildning. I analysen kommer jag vidare att försöka ge ett förslag till hur man potentiellt skulle kunna sammanfoga naturrättarnas tro på de vetenskapliga metoderna med rättspositivisternas benägenhet att inte uttala sig om något vilket inte kan sägas med säkerhet. This essay aims to investigate one of the most fundamental questions for legal scientists, namely how the laws have been legitimized throughout history and how we legitimize it today? The essay makes an attempt to examine how these questions have been answered by different philosophers throughout the ages. It starts by examining the anchient philosophers and mover forward cronologically. Within the earaly civilizations teocratism was dominating, which claimed that the normes were given by a divine force. Later ideas which claimed that we humans, with the help of our rational minds, could find norms though reasoning, natural law. This essay aims to investigate one of the most fundamental questions for legal scientists, namely how the laws have been legitimized throughout history and how we legitimize it today? The essay makes an attempt to examine how these questions have been answered by different philosophers throughout the ages. It starts by examining the anchient philosophers and mover forward cronologically. Within the earaly civilizations teocratism was dominating, which claimed that the normes were given by a divine force. Later ideas which claimed that we humans, with the help of our rational minds, could find norms though reasoning, natural law. Later on these ideas had to face critique aswell, and these ideas were questioned. It was claimed that we cannot find any scientifically proven knowledge regarding matters which cannot be the subject of scientific experiments. Those arguments led us to the legal positivism, which can be claimed to dominate the legal science of today. In the analysis some of the core questions will be analysed more deeply and hopefully some of the reasoning could be considered interesting to the continuous development. The analysis will focus on the arguments which have been put forth by others already, and be founded on the theories that exist. Finally, I will give some proposals regarding how it could be possible in the future to put together the belief of the natural law in the rational mind with the scepsism of the knowledge of the legal positivists.
