Abstract
The Swedish government is currently discussing whether to incorporate the UN:s convention on the rights of the child (CRC) into legislation or not. Furthermore, the UN:s committee on the Rights of the Child has criticized the fact that the convention is not incorporated in Swedish law. In addition, the country's way of processing child asylum cases has been questioned. Initially, the government planned to implement the CRC into Swedish law 2018. However, the implementation is currently delayed until 2020. The Swedish government is currently discussing whether to incorporate the UN:s convention on the rights of the child (CRC) into legislation or not. Furthermore, the UN:s committee on the Rights of the Child has criticized the fact that the convention is not incorporated in Swedish law. In addition, the country's way of processing child asylum cases has been questioned. Initially, the government planned to implement the CRC into Swedish law 2018. However, the implementation is currently delayed until 2020. Though the incorporation into legislation has been delayed, the Swedish government has drafted a proposition on the new asylum law that came to effect in the summer of 2016. The new law is temporary and concerns all refugees applying for permission to stay in Sweden, including children. Therefore, this study aims to investigate how the proposition drafted by the Swedish government complies with the CRC. The proposition is examined using a descriptive perspective, more specifically, the study has been based on an ideal type analysis as a method. The ideal types of the study are based on Thomas H. Marshall's theory of equality and the articles of the CRC. The study's analysis shows that the government adheres to the provisions of the CRC to a certain extent. The result of the study is not generalizable since it only contributes with knowledge based on the proposition. (Less)
