Abstract (Swedish)
Övervägande del av förundersökningar av brott mot barn läggs ner. När förövaren dessutom är en närstående eller förälder försvåras utredningen avsevärt då det sällan finns vittnen och barnet kanske inte inser att de blivit utsatta för ett brott. Dessa ärenden utreds ibland inte heller av socialnämnden trots att mängden orosanmälan ökar. Barnet har ett speciellt behov av skydd och samhället har ett ansvar att tillgodose barnets rättigheter när föräldern inte gör det.
Syftet med denna uppsats är att kartlägga processen för dessa ärenden och därigenom få en uppfattning om hur barnets bästa aktualiseras i de två olika regelsystemen.

Syftet med denna uppsats är att kartlägga processen för dessa ärenden och därigenom få en uppfattning om hur barnets bästa aktualiseras i de två olika regelsystemen.
Den socialrättsliga vägen fokuserar främst på frivilliga förebyggande åtgärder för familjen och den straffrättsliga avser att lagföra den gärningsperson som begått ett brott.
Båda processerna kan bli aktuella i samma ärende och pågå parallellt.

Sammanfattningsvis kan sägas att ingen av processerna kan fullt ut tillgodose barnets behov av skydd och barnets bästa, men genom samverkan mellan disciplinerna når vi en bit på väg. Det viktigaste för barnet är enligt forskning att en anmälan tas på allvar och leder till någon form av åtgärd. (Less)

The investigations become significantly more complicated when the perpetrator happens to be a family member or parent. Some of the difficulties occur because the child may not realize that they have been victimized and there are rarely witnesses to the acts. Children have a special need for protection and their rights looked after. Most investigations of crimes against children are terminated before being brought to court. The investigations become significantly more complicated when the perpetrator happens to be a family member or parent. Some of the difficulties occur because the child may not realize that they have been victimized and there are rarely witnesses to the acts. Children have a special need for protection and their rights looked after. When the parents fail to provide for these needs by victimizing their child, the community has a responsibility to act on behalf of the child’s well-being. Even though awareness of crimes against children has increased, inquiries and investigations are often neglected by social services.
The purpose of this essay is to analyze the existing procedures of crimes against children in cases where the perpetrator is the parent and how well the existing procedures protect the child. The essay describes the two different processes for handling these crimes as they proceed. It involves looking into the Civil Court system and the Criminal Court system to determine if each system is sufficient on its own to provide for the protection and well-being of the child or if the two systems in tandem can provide the desired protection for a child’s rights and best interest.
The Social Service’s main focus is voluntary preventative measures to help the family, whereas the criminal law-procedure aims to prosecute the offender of the crime. Both processes can be activated in one specific case and the investigations often occur simultaneously.
In conclusion, it can be determined that neither process is completely compliant with the best interest of the child or need for protection, but in combination the two legal-disciplines can protect a broader number of victims.
The most important part for the child, according to research, is when a case of neglect or violence is reported, it is taken seriously and leads to some form of action. (Less)
