Inarbetningsskyddets rättssäkerhet - med fokus på begreppet omsättningskrets

- Uppsatsen behandlar varumärkesrätten och mer specifikt hur ett varumärke erhåller skydd genom inarbetning. Inarbetningsskyddet finns stadgat i VmL:s 1 kap. 7§ och fungerar som ett alternativ till att uppnå varumärkesskydd genom registrering.
Mycket av uppsatsens fokus ligger på det krav som ställs för att ett varumärke ska anses vara inarbetat. Enligt dagens bestämmelse så ska en ”betydande del av omsättningskretsen” känna till varumärket för att inarbetning ska föreligga. Det min uppsats redogör för är hur detta krav fungerar när det tillämpas samt vad kravet egentligen innebär. Jag kommer även i min bakgrund se på inarbetningsskyddet ur en historisk synvinkel.

Rättssäkerheten på området diskuteras främst under mina avslutande reflektioner men även under andra delar av uppsatsen. Slutsatsen jag drar under min analys är att rättssäkerheten på området kan ifrågasättas. Därmed ger jag avslutningsvis ett förslag till hur jag anser att varumärkesskyddet genom inarbetning ska fungera för att styrka rättssäkerheten. (Less) - Abstract

During my analysis I conclude that the legal security in this jurisprudence may be quiestioned. Therefore a suggestion on how the protection by establishment should operate in order to strengthen the legal security is presented. (Less)
