- Abstract
- This essay addresses the legal problem of legal institutes that is alien to Swedish law. The purpose is to investigate the legal problem of this institutes as a principle and to try to identify its characteristics.
The essay addresses general problems in international private law that is related to the alien legal institutes. It highlights the legal development in Sweden by explaining three cases in which the alien legal institute called mahr has been the subject of a dispute.
Certain characteristics can be identified in the courts application of mahr and could be considered to be generally valid in relation to all alien legal institutes. These are mapped and discussed in the analysis of this essay. - Abstract (Swedish)
- Denna uppsats behandlar det juridiska problemet typfrämmande rättsinstitut i förhållande till svensk rätt. Syftet är att undersöka det juridiska problemet typfrämmande rättsinstitut som princip och att försöka identifiera dess karaktärsdrag.
Uppsatsen tar upp allmänna problem inom den internationella privaträtten som har en koppling till typfrämmande rättsinstitut. Den belyser rättsutvecklingen i Sverige genom att redogöra för tre rättsfall där rättsinstitutet mahr varit föremål för tvist.
Vissa karaktärsdrag kan identifieras i tillämpningen av mahr och anses vara allmänt giltiga i förhållande till typfrämmande rättsinstitut principiellt. Dessa kartläggs och diskuteras i analysen.
