År 2015 blev ett rekordår för Sverige vad gäller immigration. 163 000 människor sökte asyl i landet varav omkring 35 000 av dem var ensamkommande flyktingbarn. De omfattande flyktingströmmarna kom att påverka Migrationsverkets handläggningstid på asylärenden vilket resulterat i långa handläggningstider och försenade beslut. Dessa omständigheter har vidare lett till att de ensamkommande barnen hunnit bli vuxna innan prövning skett.

Genom lagförslaget om ny möjlighet till uppehållstillstånd avser regeringen möjliggöra nya grunder och förutsättningar för att bevilja uppehållstillstånd. År 2015 blev ett rekordår för Sverige vad gäller immigration. 163 000 människor sökte asyl i landet varav omkring 35 000 av dem var ensamkommande flyktingbarn. De omfattande flyktingströmmarna kom att påverka Migrationsverkets handläggningstid på asylärenden vilket resulterat i långa handläggningstider och försenade beslut. Dessa omständigheter har vidare lett till att de ensamkommande barnen hunnit bli vuxna innan prövning skett.

Genom lagförslaget om ny möjlighet till uppehållstillstånd avser regeringen möjliggöra nya grunder och förutsättningar för att bevilja uppehållstillstånd. Målet är att ensamkommande unga i större utsträckning ska få möjlighet att stanna i Sverige. Förslaget har emellertid av Lagrådet, till följd av en undermålig lagstiftningsprocess, adresserats som oacceptabelt.

Uppsatsen syftar till att utreda huruvida regeringens lagförslag om ny möjlighet till uppehållstillstånd korrelerar med rättssäkerheten. Frågeställningen fokuserar således på att klarlägga lagförslagets innebörd samt dess effekter ur ett rättssäkerhetsperspektiv baserat på Aleksander Peczeniks definition av begreppet rättssäkerhet. Utifrån Peczeniks definition innefattas bland annat förutsebarhet, etiska värden och likhet inför lagen inom begreppet. För att uppnå total rättssäkerhet krävs en balans mellan dessa komponenter.

Utifrån den kritik som propositionen fått kan slutsatsen dras att lagförslaget innehåller omfattande brister. Lagförslaget innefattar komplexa rekvisit samt avsteg från allmänna principer och huvudregler. Detta riskerar att resultera i olikhet inför lagen, icke förutsebar tillämpning samt en rättsprocess som urvattnar rättsstatens allmänna principer. (Less)
Abstract
When it comes to immigration, the year of 2015 became a record year for Sweden. In 2015, 163 000 people applied for asylum in Sweden, of whom about 35 000 of them, were unaccompanied refugee children. The extensive inflow of refugees had a comprehensive impact on the Migration Agency and its timeframes for processing the applications for asylum. This resulted in extended processing times and delayed decisions for the applicants. These circumstances further led to the result that unaccompanied children and young adults, seeking asylum on their own, turned eighteen and became adults before they received a final decision on their residence permit application from the Migration Agency.

When it comes to immigration, the year of 2015 became a record year for Sweden. In 2015, 163 000 people applied for asylum in Sweden, of whom about 35 000 of them, were unaccompanied refugee children. The extensive inflow of refugees had a comprehensive impact on the Migration Agency and its timeframes for processing the applications for asylum. This resulted in extended processing times and delayed decisions for the applicants. These circumstances further led to the result that unaccompanied children and young adults, seeking asylum on their own, turned eighteen and became adults before they received a final decision on their residence permit application from the Migration Agency.

The bill addresses a renewed opportunity for the demarcated group of children and young adults that was affected negatively by the Migration Agency’s extended processing time. The aim is for unaccompanied young adults to be able to stay in Sweden. However, the proposal has been highly controversial and criticized by The Council of the Law whom addresses the process for drafting this bill as unacceptable.

The purpose of this paper is to investigate whether the bill correlates with the principle of rule of law. The issue thus focuses on clarifying the meaning of the bill and its effects from that perspective based on Aleksander Peczenik’s definition of the term rule of law which is based on, inter alia, predictability, ethical values and everyone’s equal treatment before the law. In order to achieve total legal certainty, these values need to be balanced.

Based on the criticism raised against the bill, it can be concluded that the bill contains extensive shortcomings. The bill includes complex necessary conditions as well as deviations from general rules. This may result in inequality before the law, unpredictable adjudication and a legal process which undermines the general principles of the rule of law. (Less)
