- Det finns olika teorier kring vem som bevisbördan ska falla på inom tvistemål när det råder oenighet kring huruvida ett visst rättsfaktum ligger för handen. Bevissäkringsteorin är en av dessa. Bevissäkringsteorin innebär att bevisbördan läggs på den som har haft det lättast för att säkra bevisning. Mot bevissäkringsteorin konkurrerar de materiella bevisteorierna. Dessa teorier förespråkar att bevisbördan placeras på ett sätt så att en viss rättsregels ändamål uppfylls och att bevisbördan placeras på ett sätt som ger en handlingsdirigerande verkan.

Denna uppsats är ämnad åt att försöka lyfta fram vilka för- och motargument som ges gentemot ovan beskrivna teorier. Vidare är uppsatsen ämnad åt att undersöka hur de för- och nackdelar som lyfts fram i argumenten inverkar på teorierna förmåga att ge en förutsebar rättsprocess, en flexibel rättsprocess, en konsekvent rättsprocess och en process som ger en rättvisare rättegång i regeringsformens mening.
Efter att ha kartlagt vilka för- och motargument som ges gentemot teorierna nås slutsatsen att bevissäkringsteorin ger en mer flexibel rättsprocess och en rättsprocess som är mer rättvis i regeringsformens mening. Samtidigt dras slutsatsen att de materiella bevisteorierna är mer förutsebara och kan användas mer konsekvent. (Less) - Abstract
- There are different theories regarding who should carry the burden of proof within civil cases when there is controversy regarding whether or not a certain fact is at hand. The theory of securing evidence is one of these. The theory of securing evidence states that the burden of proof should be placed on whomever has an easier time of securing evidence. The material theories of evidence compete with the theory of securing evidence. The content of these theories is that the burden of proof should be placed in a way that the underlying purpose of a legal rule gets fulfilled and that the burden of proof is placed in a way so that it has a supervisory effect.

The material theories of evidence compete with the theory of securing evidence. The content of these theories is that the burden of proof should be placed in a way that the underlying purpose of a legal rule gets fulfilled and that the burden of proof is placed in a way so that it has a supervisory effect.
This essay aims at mapping out the arguments that are made in support of- and against aforementioned theories. Moreover this essay aims at examining the pros and cons that are detailed in the arguments affect the theories ability to provide for a predictable legal process, a flexible legal process, a consistent legal process and a legal process that provides a fairer trial in the sense of the Swedish constitutional law “regeringsformen”.
After having mapped out the arguments given in support of- and against the theories in question this essay concludes that theory of securing evidence provides for a more flexible legal process and a legal process that is more fair in the sense of “regeringsformen”. This essay also concludes that the material theories of evidence provide for a more predictable and consistent legal process. (Less)
