Abstract
The aim of this essay is to analyze how the preconditions for legal recognition of gender contribute to cis- and heteronormativity in Finland. The material used in the analysis consists of the final report of a working group which was given the assignment by the Finnish Ministry of Social Affairs and Health to investigate possible changes in the Act on Legal Recognition of Transexuals. As it stands today, the Finnish law requires that a transgendered person who desires to have legal recognition of the gender they live in, to both be sterilized and unmarried. The aim of this essay is to analyze how the preconditions for legal recognition of gender contribute to cis- and heteronormativity in Finland. The material used in the analysis consists of the final report of a working group which was given the assignment by the Finnish Ministry of Social Affairs and Health to investigate possible changes in the Act on Legal Recognition of Transexuals. As it stands today, the Finnish law requires that a transgendered person who desires to have legal recognition of the gender they live in, to both be sterilized and unmarried. The working group proposes abolishing this requirement. The method used in this essay is based on Carol Bacchi's approach in ​What’s the problem represented to be? which builds onupon Michel Foucault's Discourse Analysis. The questions raised are: How do the preconditions which the Finnish State imposes on the individual who applies for legal recognition of gender contribute to cis- and heteronormativity in 2010s Finland? How is gender and sex presented in the government’s official documents? And what can be interpreted through what is not written in the documents? The conclusion of this essay is that the preconditions for transpeople violate their integrity and human rights and that they contribute to cis- and heteronormativity in the Finnish society. (Less)
