Kontinuitetsprincipen i praktiken - Hur tillämpas den familjerättsliga kontinuitetsprincipen i tingsrätterna?

Frågan om vad som utgör barnets bästa är ständigt föremål för diskussion. Den här uppsatsen tar sikte på att förklara kontinuitetsprincipen i teori respektive praktik. Praktik i denna uppsats mening avser hur tingsrätter runt om i landet har tillämpat principen i vårdnadstvister. Uppsatsens första del ger den grundläggande rättsliga förståelsen för begrepp som vårdnad, kontinuitetsprincipen och barnets bästa. Den andra delen av uppsatsen analyserar 15 tingsrättsdomar, i vilka domstolen i någon mån resonerar kring kontinuitetsprincipen.

Frågan om vad som utgör barnets bästa är ständigt föremål för diskussion. Den här uppsatsen tar sikte på att förklara kontinuitetsprincipen i teori respektive praktik. Praktik i denna uppsats mening avser hur tingsrätter runt om i landet har tillämpat principen i vårdnadstvister. Uppsatsens första del ger den grundläggande rättsliga förståelsen för begrepp som vårdnad, kontinuitetsprincipen och barnets bästa. Den andra delen av uppsatsen analyserar 15 tingsrättsdomar, i vilka domstolen i någon mån resonerar kring kontinuitetsprincipen.

Analysen syftar till att besvara frågan om hur kontinuitetsprincipen tillämpas i tingsrätter. Undersökningen avgränsas till att behandla principen i vårdnadsmål. Analysen ger vid handen ett ganska blandat resultat. Kontinuitetsprincipen i vissa mål får genomslag och andra inte. Sambanden mellan fallen där kontinuitetsprincipen faktiskt får genomslag kan sägas vara att det i dessa fall inte finns någonting annat för domstolen att luta sina domskäl mot. Det är dock inte alltid tydligt varför domstolen dömer som den gör, vilket gör det svårt att dra några slutsatser om kontinuitetsprincipen. En slutsats som dock kan dras är att kontinuitetsprincipens betydelse beror på andra faktorer som spelar in i bedömningen av vad som är ett barns bästa.

För att slutsatserna ska ge mening ges läsaren de grundläggande kunskaperna om portalparagrafen vad gäller barnets bästa. Den aktuella paragrafen återfinns i 6:2a föräldrabalken (FB). Paragrafen har av lagstiftaren lämnats relativt vag och flexibel. Detta för att undvika stelbent rättstillämpning när det kommer till avgörandet av vad som utgör ett individuellt barns bästa. Barnets bästa ska dessutom bedömas i varje enskild situation. Mot bakgrund av lagstiftarens önskan om en flexibel paragraf anläggs ett rättssäkerhetsperspektiv i uppsatsen. Uppsatsen avslutas med en diskussion om rättsväsendets möjliga förhållningssätt till kontinuitetsprincipen. (Less)
Abstract
The child’s best interest is always a topic of discussion. In Swedish family law, the principle of continuity is an aspect to be considered in the determination of the child’s best interest. This thesis aims at explaining the principle of continuity in theory and in practice. Practice in this thesis refers to how district courts in Sweden have been applying the principle of continuity in custody disputes.

The first part of this thesis gives the basic legal understanding of concepts such as custody, the principle of continuity and the child’s best interest. The second part of this thesis analyzes fifteen district court judgments, judgements in which the court to some extent is discussing the principle of continuity.

The child’s best interest is always a topic of discussion. In Swedish family law, the principle of continuity is an aspect to be considered in the determination of the child’s best interest. This thesis aims at explaining the principle of continuity in theory and in practice. Practice in this thesis refers to how district courts in Sweden have been applying the principle of continuity in custody disputes.

The first part of this thesis gives the basic legal understanding of concepts such as custody, the principle of continuity and the child’s best interest. The second part of this thesis analyzes fifteen district court judgments, judgements in which the court to some extent is discussing the principle of continuity.

The analysis aims at answering the question of how the principle of continuity is applied in district courts. The analysis gives a fairly mixed result at hand, where the principle of continuity in some cases influences the judgement and in other cases it does not. The correlation between the cases where the principle of continuity is taken into consideration can be said to be that in those cases, there is no other principle or rule for the district court to rely on.

However, it is not entirely clear why the court judges as it does, making it hard to draw any conclusions about the principle of continuity. One conclusion that can be drawn is, however, that the importance of continuity depends on other factors.

To be able to understand the aims of this thesis and the conclusions drawn the reader is provided basic knowledge of the most important articles and principles concerning the child’s best interest. In Swedish law, the most important article regarding the child’s best interest has deliberately been kept vague and flexible by the legislator. That is motivated by the purpose of avoiding rigid law enforcement in determining what constitutes an individual child’s best interests. Furthermore, the child’s best interest should always be assessed in each individual situation. This is part of the explanation of why it is hard to draw solid conclusions about the use of the principle of continuity in the Swedish district courts. This, as well as other contributing factors, are being discussed in this thesis.

The rule of law is one of the most basic principles in every democratic state.
Because of the chosen legislator technique regarding the most important article about the child’s best interest, the rule of law is being discussed in relation to the use of the principle of continuity. The thesis ends with a discussion about the legal system's possible approach to the principle of continuity. (Less)
