Nödvändigt eller nyttigt? - En kritisk granskning av XS2A-bestämmelserna i PSD2 och deras förenlighet med begreppet nödvändig nyttighet

Abstract
To operate in certain markets, it is sometimes a necessity to access certain infrastructure or facilities. The term essential facility has been used by practitioners since the beginning of the 20th century, to justify the need for such access. The essential facilities doctrine is the result of repeated use of the term essential facility in American court cases.

In European competition law, the use of the term essential facility began in the early 1990s. Since then, essential facility has become an established and recognized part of European competition law.

To operate in certain markets, it is sometimes a necessity to access certain infrastructure or facilities. The term essential facility has been used by practitioners since the beginning of the 20th century, to justify the need for such access. The essential facilities doctrine is the result of repeated use of the term essential facility in American court cases.

In European competition law, the use of the term essential facility began in the early 1990s. Since then, essential facility has become an established and recognized part of European competition law.

The rapid development of new technology has resulted in new and innovative ways of managing payments. Modern payment service users are getting accustomed to faster and easier ways of handling daily payments. Technological development has also resulted in new challenges for European legislators.

For the purpose of harmonizing the regulation of payment services in the internal market, the European Parliament and the Council of the European Union have adopted two payment service directives. The latest directive to have been adopted was Payment Service Directive 2. In this directive, the legislator has recognized the request from new payment service providers to access payment accounts and payment account information. With PSD2, account managing operators are forced, with the explicit approval of the user, to grant such new payment service providers access to their infrastructure.

This thesis examines the legal development in the field of payment services, with focus on the new “access to account”-regulations in PSD2. The examination is made by comparing the new regulations with the compatibility of the term essential facility. (Less)

För att bedriva verksamhet på vissa marknader är det ibland en nödvändighet att få tillgång till viss infrastruktur. Begreppet nödvändig nyttighet har använts av praktiker sedan början av 1900-talet för att i vissa fall rättfärdiga behovet av sådan tillgång. Doktrinen om nödvändiga nyttigheter är resultatet av den upprepade användning av begreppet nödvändig nyttighet inom amerikansk rättspraxis.

Inom den europeiska konkurrensrätten började begreppet nödvändig nyttighet att användas i början av 1990-talet. Sedan dess har begreppet blivit en etablerad och erkänd del av den europeiska konkurrensrätten.

I syfte att harmonisera regleringen inom området för betaltjänster på den inre marknaden har Europaparlamentet och rådet antagit två betaltjänstdirektiv. Det senaste direktivet att antas var Payment Service Directive 2, PSD2. I direktivet har lagstiftaren uppmärksammat en önskan från de nya betaltjänstleverantörerna om att få tillgång till betalkonton och kontoinformation. Med PSD2 tvingas de kontoförvaltande aktörerna på marknaden att, med ett uttryckligt godkännande från betaltjänstanvändaren, bevilja de nya betaltjänstleverantörerna tillgång till deras infrastruktur.

Den här framställningen innehåller en kritisk granskning av den rättsliga utvecklingen med fokus på PSD2:s bestämmelser om tillgång till kontosystem. Den kritiska granskningen sker genom en jämförelse av bestämmelserna i PSD2 med det konkurrensrättsliga begreppet nödvändig nyttighet. (Less)
