- Allas likhet inför lagen har i det svenska rättssystemet en central och avgörande roll, men är alla verkligen lika inför lagen? Ett ämne som i anslutning till frågan diskuteras inom de flesta delarna av juridiken, och inom andra ämnen för den delen, är kön och genus.
Den svenska sexualbrottslagstiftningen är vid första anblick könsneutral, men hur ligger det till med förarbeten? Vad sker när domstolarna tillämpar denna könsneutrala lagstiftning, appliceras någon föreställning om kön då?
När ett sexualbrottsmål ska utredas används en heterosexuellt jämförelsenorm för att bedöma offrets kränkning. Normen är omdiskuterad och har både kritiserats och försvarats, precis som är fallet med teorin om det ideala brottsoffret. Uppsatsen... När ett sexualbrottsmål ska utredas används en heterosexuellt jämförelsenorm för att bedöma offrets kränkning. Normen är omdiskuterad och har både kritiserats och försvarats, precis som är fallet med teorin om det ideala brottsoffret. Uppsatsen tydliggör vad den heterosexuella jämförelsenormen och teorin om det ideala brottsoffret egentligen innebär, och förklarar vad de har för anknytning till föreställningar om kön.
Två rättsfall som det ofta hänvisas till när sexualbrott diskuteras är NJA 2008 s. 482 I och II. Det är två fall där omständigheterna är liknande, men där utfallen blir två olika. Den största skillnaden i fallen är att det i det första fallet är ett kvinnligt offer, och i det andra ett manligt. Rättsfallen diskuteras i uppsatsen, och det undersöks om det är just offrets kön som är anledningen till de olika utfallen. (Less) - Abstract

A heterosexual comparison norm is used when a sexual crime victim’s mental injury is estimated. This norm, as well as the theory of the ideal victim, is highly debated and has been both criticized and justified. This essay clarifies what the heterosexual comparison norm and the theory of the ideal victim actually means, and explains their connection to presumptions about sex and gender.
Two court cases which are often referred to when sexual crimes are being discussed, are the Swedish cases NJA 2008 s. 482 I and II. The two cases have similar circumstances, but the outfall is completely different. The main difference in the circumstances is that the victim in the first case is a woman, and in the second case a man. The cases are being discussed throughout the essay, and it will be examined whether the reason for the different outcomes is the sex of the victim or not. (Less)
