Våldtäkter som ett krigsvapen i väpnade konflikter utgör en av historiens stora tystnader. Det var först under 1990-talet, genom de internationella krigsförbrytartribunalerna i forna Jugoslavien (ICTY) och Rwanda (ICTR), som det internationella samfundet uttryckligen erkände våldtäkt som brott mot mänskligheten.

Den Internationella brottmålsdomstolen, ICC, grundades den 1 juli 2002. Det var dock inte förrän 2016 som ICC dömde en person till personligt straffansvar för våldtäkt som begåtts av dennes soldater i samband med en väpnad konflikt. Emellertid, beslutade ICC:s överklagandeinstans att fria personen från våldtäkt som brott mot mänskligheten.

Det var dock inte förrän 2016 som ICC dömde en person till personligt straffansvar för våldtäkt som begåtts av dennes soldater i samband med en väpnad konflikt. Syftet med uppsatsen är att undersöka rättsutvecklingen av kvinnors skydd mot våldtäkter i väpnade konflikter samt analysera huruvida skyddet har stärkts sedan ICC etablerades. Vidare kommer uppsatsen utreda rekvisiten för våldtäkt som brott mot mänskligheten. Dessutom belyses relationen mellan FN:s säkerhetsråd och ICC i förhållande till våldtäkt som ett brott mot mänskligheten.

Uppsatsen kommer påvisa att kvinnors rättsliga skydd mot våldtäkter i väpnade konflikter delvis har stärkts genom ICC, men att den viktigaste utmaningen kvarstår. Vidare visar uppsatsen att Säkerhetsrådet hämmar ICC från att uppnå målet att minska straffriheten samt förebygga och avvärja våldtäkter i väpnade konflikter. (Less)

Rape as a weapon of war in armed conflicts is one of the history’s great silences. It was not until the 1990’s, through the International Criminal Tribunals for the former Yugoslavia (ICTY) and Rwanda (ICTR), that the international community explicitly recognized rape as a crime against humanity.

The International Criminal Court, ICC, was established on 1 July 2002. However, it was not until 2016 that the ICC convicted a person for using rape as a systematic strategy in war. The rapes had been committed by the soldiers who were under the person’s command. Unfortunately, the Appeals Chamber of the International Criminal Court decided to acquit the person from all charges of rape as a crime against humanity.

The essay aims to analyze the legal protection of women under international law against rape in armed conflicts and whether the legal protection has developed since the ICC was established. Furthermore, the essay will give a comprehensive analysis of the requirements necessary for rape to be prosecuted as a crime against humanity. Additionally, the essay will describe the relationship between the United Nations Security Council and the ICC, in relation to rape as a crime against humanity.

This thesis will argue that womens’ legal protection under international law against rape in armed conflicts has developed, but it is not enough to ensure sufficient legal protection and the main challenge to reduce impunity remains. Furthermore, the thesis argues that the UN Security Council constrains the ICC from achieving its purpose of reducing impunity and preventing rape in armed conflicts. (Less)
