Abstract
A system with crown witnesses is today discussed as a measure against organized crime or gang-related crime. A crown witness is a defendant that, in exchange of reduction of sentence or relief of sentence, contributes to an investigation of someone else’s crime.

The thesis, which is based on a critical legal dogmatic method, aim to add a victim of crime’s perspective to the discussion about the potential introduction of a system with crown witnesses. The thesis investigates what role victims of crime have in the discussion about the potential introduction of a system with crown witnesses. The thesis also investigates to what extent a system with crown witnesses takes into account victims of crime and their need of vindication.

A system with crown witnesses is today discussed as a measure against organized crime or gang-related crime. A crown witness is a defendant that, in exchange of reduction of sentence or relief of sentence, contributes to an investigation of someone else’s crime.

The thesis, which is based on a critical legal dogmatic method, aim to add a victim of crime’s perspective to the discussion about the potential introduction of a system with crown witnesses. The thesis investigates what role victims of crime have in the discussion about the potential introduction of a system with crown witnesses. The thesis also investigates to what extent a system with crown witnesses takes into account victims of crime and their need of vindication.

The term “victim of crime” is introduced in Sweden in the 1970s. Today, nearly 50 years later, there are numerous of laws in Sweden that aims to protect victims of crime. Both legislation and expressions in legislative preparatory work demonstrate a political will to protect victims of crime, their needs and their interests.

There seems to be a presumption that a system with crown witnesses are, in essence, good for victims of crime. There is no discussion about what disadvantages a system with crown witnesses may have for victims of crime. Victims of crime have a remarkable small role in the discussion, considering the increased focus on victims of crime within the Swedish criminal politics.

The presumption seems to rely on a notion that a system with crown witnesses, by solving crimes, may give more victims of crime the opportunity to vindication. A notion like that rely on an assumption that victims of crime may have the opportunity to vindication even when their perpetrators are given reduction of sentence or relief of sentence because of their insight or involvement in a criminal network.


The thesis presents three theories about victims of crime and their need of vindication. To what extent a system with crown witnesses takes into account victims of crime and their need of vindication depends on the meaning of the term “vindication”. It is not certain that a system with crown witnesses takes into account victims of crime´s need of vindication. (Less)

Införandet av ett så kallat kronvittnessystem diskuteras i dag som en åtgärd mot den organiserade brottsligheten. Ett kronvittne är en person som mot löfte om strafflindring eller straffbefrielse medverkar till en utredning av någon annans brottslighet.
 
Uppsatsen, som utgår från en kritisk rättsdogmatisk metod, ämnar till att tillföra ett tydligt brottsofferperspektiv till diskussionen beträffande införandet av ett kronvittnessystem. I uppsatsen undersöks dels vilken roll brottsoffer har i diskussionen beträffande införandet av ett kronvittnessystem, dels i vilken mån ett kronvittnessystem tar hänsyn till brottsoffers behov av upprättelse. Begreppet brottsoffer introduceras i Sverige på 1970-talet. I dag, närmare 50 år senare, finns det ett stort antal lagar som avser att skydda brottsoffer. Lagstiftning och uttalanden i lagförarbeten visar att det finns en kriminalpolitisk vilja att skydda brottsoffer, deras behov och intressen.

Det verkar finnas en presumtion om att ett kronvittnessystem, i grund och botten, är någonting positivt för brottsoffer. Det saknas en diskussion beträffande vilka eventuella nackdelar, som sett ur ett brottsofferperspektiv, finns med ett införande av ett kronvittnessystem. Brottsoffer får, mot bakgrund av den allt mer brottsofferinriktade kriminalpolitiken, anses ha en iögonfallande liten roll i diskussionen beträffande införandet av ett kronvittnessystem.

Den ovan nämnda presumtionen verkar vila på en föreställning om att ett kronvittnessystem, i egenskap av ett brottsbekämpningsmedel, kan ge fler brottsoffer möjlighet till upprättelse. En sådan föreställning förutsätter att brottsoffer kan få upprättelse samtidigt som deras förövare medges strafflindring eller straffbefrielse till följd av deras insyn eller inblandning i en brottslig verksamhet.

I uppsatsen redogörs för tre teorier vad gäller brottsoffer och deras behov av upprättelse. I vilken mån ett kronvittnessystem kan tar hänsyn till brottsoffers behov av upprättelse beror på vilken innebörd begreppet upprättelse ges. Det är inte givet att ett kronvittnessystem tar hänsyn till brottsoffers behov av upprättelse. (Less)
