En grundprincip inom svensk processrätt är den fria bevisprövningen. Den fria bevisprövningen framstår dock inte som helt självklar genom inflytande från främst europeisk rätt.

I denna uppsats undersöks principen om fri bevisförings ställning vid konflikter mellan nationell rätt och internationella överenskommelser. Undersökningen görs genom klarläggande av praxis från Europadomstolen och Högsta domstolen. Till undersökningen används även förarbetet till Konkurrensskadelagen som diskuterar prioriteringen mellan krav från kommittédirektiv och den fria bevisprövningen.

En grundprincip inom svensk processrätt är den fria bevisprövningen. Den fria bevisprövningen framstår dock inte som helt självklar genom inflytande från främst europeisk rätt.

I denna uppsats undersöks principen om fri bevisförings ställning vid konflikter mellan nationell rätt och internationella överenskommelser. Undersökningen görs genom klarläggande av praxis från Europadomstolen och Högsta domstolen. Till undersökningen används även förarbetet till Konkurrensskadelagen som diskuterar prioriteringen mellan krav från kommittédirektiv och den fria bevisprövningen.

Genom undersökningen och kartläggningen av gällande rätt dras slutsatsen att det rör sig om motstående intressen. Principen om fri bevisföring får ibland anpassas för att andra intressen värderas högre så som artikel 3 i Europakonventionen om mänskliga rättigheter som ger rätten till att inte bli utsatt för tortyr eller omänsklig behandling. Abstract
A fundamental part of Swedish procedural law is the principle that the process of both submitting evidence and the evaluation of this evidence should be free, as in not regulated by law. Due to Swedens international agreements such as being a member of the European Union brings with them some legally binding demands.

The main purpose of this thesis is to evaluate the standing of this principle when it is valued against these international commitments. By analysing court cases from both the european court of human rights and Swedish national courts the legal standing of this principle is examined. One other important document for this evaluation is the suggestion for a new law in Sweden to conform to European law.
