Lagligheten i användandet av sexdockor

Sexleksaker är inget nytt fenomen. Det är en industri som har funnits länge och precis som med all annan industri så har den utvecklats. Även om sexdockan inte är ett nytt fenomen så har den kommit att få en helt ny innebörd. Utvecklingen har gått från den klassiska uppblåsbara ”Barbara” till en högteknologisk docka i material som ger en verklighetstrogen känsla och som ska ge maximal njutning till användaren. Dessutom finns det olika dockor för olika preferenser. Det rör sig om gravida dockor, korta, långa, med olika kroppsbyggnad och dessutom har tullverket i bland annat Norge och Sverige beslagtagit dockor som efterliknar barn.

Utvecklingen har gått från den klassiska uppblåsbara ”Barbara” till en högteknologisk docka i material som ger en verklighetstrogen känsla och som ska ge maximal njutning till användaren. Dessutom finns det olika dockor för olika preferenser. Det rör sig om gravida dockor, korta, långa, med olika kroppsbyggnad och dessutom har tullverket i bland annat Norge och Sverige beslagtagit dockor som efterliknar barn.
Två perspektiv aktualiseras när man gör en närmare djupdykning i ämnet. Det finns de som hävdar att det krävs en kriminalisering av användandet av sexdockor för att inte normalisera den sexobjektifieringen som genom användandet sker av män mot kvinnor. Samma åsiktsbildare menar att det våld som kan förekomma i samband med användandet av sexdockorna kan normalisera det våld mot kvinnor som förekommer i samband med sexualbrott. De menar även att det i förlängningen kan leda till att sexualbrotten kan komma att öka och att våldet kan bli grövre. Förespråkare för det andra perspektivet menar att sexdockorna kan få stor betydelse för de människor som inte förmår att ta kontakt med kvinnor och genom en sådan interaktion få utlopp för sin sexualitet. De hävdar att användningen av dockorna bidrar till att användarn får leva ut sina sexuella fantasier och således inte behöver interagera med en levande kvinna. Hit hör människor med begränsad social förmåga men även de med fysiska begränsningar i vardagen.
Syftet med uppsatsen är att utreda vad som rent rättsligt gäller för användandet av sexdockor. Initialt ska det undersökas om det finns någon rådande lagstiftning som kan tillämpas på användandet av sexdockor som efterliknar kvinnor och för sexdockor som efterliknar barn. För det fall det inte finns någon sådan lagstiftning ska det utredas huruvida det finns möjlighet att faktiskt kriminalisera handlingen.
Resultatet av den rättsutredning som gjorts under uppsatsen gång visar på att användandet av sexdockor som efterliknar barn omfattas av barnpornografibrottet i BrB 16:10 a. Sexdockor som efterliknar kvinnor är i dagläget inte kriminaliserat men det finns verktyg för att få tillstånd en sådan kriminalisering om man anser att behovet finns. (Less)

Two perspectives are highlighted when making a closer dive into the subject. There are those who claim that a criminalization of the use of sex dolls is required in order not to normalize the sex objectification that is done by men against women. The same viewer believes that violence that can occur in connection with the use of the sex dolls can normalize violence against women in connection with sexual offenses. People with this view argue that in the long run it can lead to the fact that sex crimes may increase and that violence can become severe. Advocates of the other perspective believe that the sex dolls can have great significance for those people who are unable to make contact with women and through such interaction get outlets for their sexuality. They claim that the use of the dolls helps the user to live out their sexual fantasies and thus does not need to interact with a living woman. The people that in this respect might use sex dolls include people with limited social skills, but also those with physical limitations in everyday life.
The purpose of this thesis is to investigate the legality of the use of sex dolls. Initially, it will be investigated whether there is any existing legislation that can be applied to the use of sex dolls that mimic women and for sex dolls that mimic children. If there is no such legislation, it will be investigated whether it is possible to actually criminalize the use.
The result of the legal investigation in connection with this paper shows that the use of sex dolls that mimic children is criminalized as a child pornography crime in according with BrB 16:10 a. Sex dolls that mimic women are however not criminalized, but could most likely be criminalized if one considers that the need exists. (Less)
