Fenomenet utstationering av arbetstagare på EU:s inre marknad regleras i såväl unionsrätten som i medlemsstaternas nationella arbetsrätt. Uppsatsen undersöker hur rättsutvecklingen sett ut på unionsnivå med avseende på regleringen utstationering av arbetstagare och hur denna rättsutveckling påverkat den svenska arbetsrätten. Utvecklingen har präglats av framtagandet av sekundärrättsliga instrument som antagits stärka möjligheten till utsträckande av nationell reglering. Rättsutvecklingen har också påverkats av en rättstillämpning som stärkt den fria rörlighetens genomslag i regleringen av utstationeringar och därmed begränsat utrymmet för utsträckning av nationella arbetsvillkor. Fenomenet utstationering av arbetstagare på EU:s inre marknad regleras i såväl unionsrätten som i medlemsstaternas nationella arbetsrätt. Uppsatsen undersöker hur rättsutvecklingen sett ut på unionsnivå med avseende på regleringen utstationering av arbetstagare och hur denna rättsutveckling påverkat den svenska arbetsrätten. Utvecklingen har präglats av framtagandet av sekundärrättsliga instrument som antagits stärka möjligheten till utsträckande av nationell reglering. Rättsutvecklingen har också påverkats av en rättstillämpning som stärkt den fria rörlighetens genomslag i regleringen av utstationeringar och därmed begränsat utrymmet för utsträckning av nationella arbetsvillkor. EU-domstolens rättstillämpning har lett till en konflikt mellan det svenska genomförandet av EU-rätten och Sveriges internationella åtaganden i förhållande till grundläggande sociala rättigheter. Det svenska genomförandet av unionsrätten har genomgått flera förändringar där möjligheten att vidta stridsåtgärder i kollektivavtalssyfte begränsats och därefter liberaliserats något. Frågan om förenlighet mellan den svenska regleringen och unionsrätten är inte definitivt avgjord. Genom förändringar i fördragen och sekundärrätten har de grundläggande rättigheternas och den sociala dimensionens ställning i unionsrätten stärkts. Huruvida ändringarna i den unionsrättsliga lagstiftningen förändrat balansen mellan den sociala dimensionen av unionsrätten och den fria rörligheten för tjänster i regleringen av utstationeringar har inte besvarats definitivt. Abstract
The posting of workers within the internal market of the EU is regulated in European Union law as well as the labour law of member states. The purpose of this thesis is to examine how the regulation of the posting of workers has evolved in European Union law and how this legal development has impacted Swedish labour law as it pertains to the posting of workers. This field of regulation has been impacted by the adoption of the Posted Workers Directive and other instruments of secondary law relating to the extension and surveillance of working conditions in the host states labour law systems. The case law of the Court of Justice of the European Union has also had a profound impact by strengthening the freedom of movement for services and... (More)
The posting of workers within the internal market of the EU is regulated in European Union law as well as the labour law of member states. The purpose of this thesis is to examine how the regulation of the posting of workers has evolved in European Union law and how this legal development has impacted Swedish labour law as it pertains to the posting of workers. This field of regulation has been impacted by the adoption of the Posted Workers Directive and other instruments of secondary law relating to the extension and surveillance of working conditions in the host states labour law systems. The case law of the Court of Justice of the European Union has also had a profound impact by strengthening the freedom of movement for services and limiting the scope within which the national regulation of working conditions could be extended to posted workers within the state. This case law-driven legal development has impacted the implementation of the PWD and the governance of working conditions in Sweden. The limitations imposed on the right to collective action and collective bargaining following from the restrictive interpretation of the PWD has been criticized by international bodies governing instruments of fundamental labour rights. The adoption of the Treaty of Lisbon and changes in the secondary law of the EU has strengthened the social dimension and the role of fundamental rights in the EU but the impact of these changes on the balance between the freedom of movement and the social dimension is not clear. The restrictions on collective action and collective bargaining in Swedish law have been partially liberalized in later years but the question of compliance between the current regulation and EU law has not been definitively ruled on.
