The origins of Swedish competition law - An overview

Abstract
The development of Swedish competition law started in the early 1900s. After a long time period of motions, debates and committee reports a law was created in 1925,”Lag om undersökning angående monopolistiska företag och sammanslutningar”.

This thesis contains an overview of the development of that law. The thesis begins by highlighting some the motions put forth between 1910 and 1920, showing the growing concern among many politicians that cartels and trusts were left unchecked. A short overview of the political arguments for and against an intervention against trust and cartels is described.

The development of Swedish competition law started in the early 1900s. After a long time period of motions, debates and committee reports a law was created in 1925,”Lag om undersökning angående monopolistiska företag och sammanslutningar”.

This thesis contains an overview of the development of that law. The thesis begins by highlighting some the motions put forth between 1910 and 1920, showing the growing concern among many politicians that cartels and trusts were left unchecked. A short overview of the political arguments for and against an intervention against trust and cartels is described.

The second part of the thesis contains the description of the Trust Law Committee founded in 1920. The Committee was one of the bigger turning points in the development of the abovementioned law as it led to the gov-ernments’ proposition a few years later.

The proposition is described and discussed in the third chapter. The chapter also contains the political discussion surrounding the proposition.

Lastly a short analysis is made. It can be concluded that there were many reasons for the long time it took for the law to get created. Political differ-ences, a world war, the apparent miscommunication between investigations and parliament are just a few of the reasons. In the end a short it is conclud-ed that ”Lag om undersökning angående monopolistiska företag och sam-manslutningar” may not be the first true “competition” law, but it was the first major step in that direction. Utvecklingen av svensk konkurrenslagstiftning började i början av 1900-talet. Efter en lång period av motioner, debatter och utskottsrapporter skapades 1925, "Lag om undersökning angående monopolistiska företag och sammanslutningar".

Uppsatsen innehåller en översikt av lagens utveckling. Uppsatsen börjar
med att lyfta fram några motioner som skrevs mellan 1910 och 1920. Dessa
visar den växande oron hos många politiker att lämna karteller och truster okontrollerade. En kort översikt över de politiska argumenten för och mot ett ingripande mot truster och karteller beskrivs.

Utvecklingen av svensk konkurrenslagstiftning började i början av 1900-talet. Efter en lång period av motioner, debatter och utskottsrapporter skapades 1925, "Lag om undersökning angående monopolistiska företag och sammanslutningar".

Uppsatsen innehåller en översikt av lagens utveckling. Uppsatsen börjar
med att lyfta fram några motioner som skrevs mellan 1910 och 1920. Dessa

Slutligen görs en kort analys. Det fanns många orsaker till att det tog lång tid från första motionen till införandet av lagen. Politiska skillnader, ett världskrig, och den uppenbara misskommunikationen mellan utredningar och parlamentet är bara några av anledningarna. Avslutningsvis konstateras det att "Lag om undersökningar om monopolistiska företag och sammanslutningar" inte kan vara den första riktiga "konkurrenslagen", men det var det första stora steget i den riktningen.
