Abstract
International studies suggest that transgender prisoners are a conundrum for the prison and probation systems when it comes to both management and housing, are at risk of victimization by both inmates and prison staff and that this might impact on transgender inmates’ gender expression or gender identification. There are no studies on transgender inmates’ contact with the Swedish prison and probation service. International studies suggest that transgender prisoners are a conundrum for the prison and probation systems when it comes to both management and housing, are at risk of victimization by both inmates and prison staff and that this might impact on transgender inmates’ gender expression or gender identification. There are no studies on transgender inmates’ contact with the Swedish prison and probation service. By defining transgenderism as a deviation to the actor’s perception of the expectations to his/her gendered actions, held by the surrounding people, this paper applies a perspective of control to examine if transgender inmates’ gender expression or gender identification are being controlled inside Swedish prisons. By applying a juridical method to understand the rules regarding inmate housing, and by interviewing staff at the Swedish prison and probation service, the potential impact by three different controllers has been examined; the state, social forces and actors’ self-control. The results suggest that the Swedish prison and probation service might have great power of controlling inmates’ gender identity. Further, the social group of inmates might place negative sanctions, and the hierarchical structures might allow disciplinary punishment on transgender inmates’, at least in prisons for men. The interviews did not give any implications that prison staff would be involved in any negative sanctioning, instead, suggestions are made that prison personal might provide support. Any conclusions as to whether the primary actor might apply self-control were not able to be drawn out of the empirical material. (Less)
