Abstract
This thesis analyzes and illustrates the legal prerequisites for liability regarding self-driving vehicles, with the objective to contribute with new knowledge, an understanding of how technology impacts on the content of Swedish Criminal Law. By applying a perspective of sociology of law this study problematizes the legal constructions of responsibility and how its principles and concepts are affected by norms in relation to knowledge and practice within this field.

This thesis analyzes and illustrates the legal prerequisites for liability regarding self-driving vehicles, with the objective to contribute with new knowledge, an understanding of how technology impacts on the content of Swedish Criminal Law. By applying a perspective of sociology of law this study problematizes the legal constructions of responsibility and how its principles and concepts are affected by norms in relation to knowledge and practice within this field.

With focus on the Penal Code, the main question is based on how criminal liability is constructed in Swedish criminal law and what challenges for liability are being handled. The sub questions investigate in what way these vehicles are regulated? What does the development of liability regarding self-driving vehicles look like?

By using a traditional legal method and applying legal sources in the interpretation of legal provisions to understand the criminal law, combined with qualitative analysis of secondary data, the study shows that the existing law is challenged in many ways. Inter alia basic concepts such as “legal subject”, driver and owner of the vehicles. The social legal theories clarify the relationship between society and law where the normative perspective is used to analyze how the law has been influenced by international and national norms. The theory also describes how legislators regulate the use of automated vehicles by introducing new crimes. The theory of risk has been used to describe the unclear responsibility for accidents and crimes involving autonomous vehicles where the development involves risks. (Less)
