- Sport is a phenomenon that is often characterized by uniting people on a global level. The foundation of sports should be a zone protected from political restrictions and discriminating behavior. Even though it is this image of fair-play and unity that should be sought, it is not uncommon for various opposing interests to influence the field of sports. Often it is the individual practitioners who get caught up in it.
In sports, just as in the field of law, there are mechanisms for dealing with various norm violations. For example, an individual practitioner or a sports federation may bring an action in the Court of Arbitration for Sport, CAS, to settle rising disputes. The foundation of sports should be a zone protected from political restrictions and discriminating behavior. Even though it is this image of fair-play and unity that should be sought, it is not uncommon for various opposing interests to influence the field of sports. Often it is the individual practitioners who get caught up in it.
In sports, just as in the field of law, there are mechanisms for dealing with various norm violations. For example, an individual practitioner or a sports federation may bring an action in the Court of Arbitration for Sport, CAS, to settle rising disputes. But there are cases of discrimination where the discriminatory conduct can be attributed to a state, whereupon the rules of state responsibility could be applicable.
The essay aims to investigate whether it is possible to apply the rules of state responsibility regarding discrimination in sporting contexts. Applying the rules of state responsibility on sports is problematic. The essay thus discusses the possibilities for an extension of the state responsibility rules with the purpose of including cases of discrimination in sports that have been established at an institutional level.
The essay also discusses whether there is room in international law for a special regulation with the purpose of including the cases of discrimination on sporting events that the essay identifies. (Less) - Abstract (Swedish)
- Idrott är ett fenomen som ofta karakteriseras av sin förmåga att verka sammanförande på ett globalt plan. Som utgångpunkt bör idrotten vara en zon fredad från politiska inslag och diskriminering. Även om denna bild av fair-play och god sammanhållning är eftersträvad så är det inte sällan som olika motstående intressen tränger sig in på idrottens område och det är inte heller sällsynt att enskilda utövare hamnar i kläm.

Uppsatsen syftar till att utreda huruvida det är möjligt att tillämpa reglerna kring statsansvar i internationell rätt på diskriminering i idrottssammanhang. De rekvisit som ska vara uppfyllda, för att reglerna gällande statsansvar ska kunna tillämpas, är i många fall problematiska att sammankoppla med idrotten. Uppsatsen diskuterar således möjligheterna till en utvidgning av statsansvarsreglerna i syfte att träffa det diskriminerande agerande som i nuläget är rättsligt svårt att komma åt inom idrotten.
I uppsatsens avslutande kapitel förs en diskussion kring huruvida det finns utrymme på rättens område för en speciell reglering med syftet att fånga upp de fall som uppsatsen identifierar, i form av exempelvis en idrottskonvention. (Less)
