Samhällsskydd på bekostnad av individens rättigheter? – En utredning av hur rättspsykiatrisk vård med särskild utskrivningsprövning förhåller sig till Europadomstolens praxis utifrån ett kritiskt rättighetsperspektiv.

I det svenska rättssystemet sker en särbehandling av lagöverträdare som lider av en psykisk störning. Istället för exempelvis ett fängelsestraff, finns möjligheten för rätten att som påföljd överlämna en individ till rättspsykiatrisk vård. Den rättspsykiatriska vården kan vara förenad med särskild utskrivningsprövning, vilket regleras i lag (1991:1129) om rättspsykiatrisk vård. Detta innebär att det är förvaltningsrätten, inte chefsöverläkaren, som prövar frågan om utskrivning. Förvaltningsrätten kan därmed utesluta utskrivning om det vid prövningen framkommer att en patient riskerar att återfalla i brottslighet, alternativt att fortsatt vård anses påkallat med hänsyn till patientens personliga förhållanden i övrigt. Den rättspsykiatriska vården kan vara förenad med särskild utskrivningsprövning, vilket regleras i lag (1991:1129) om rättspsykiatrisk vård. Detta innebär att det är förvaltningsrätten, inte chefsöverläkaren, som prövar frågan om utskrivning. Förvaltningsrätten kan därmed utesluta utskrivning om det vid prövningen framkommer att en patient riskerar att återfalla i brottslighet, alternativt att fortsatt vård anses påkallat med hänsyn till patientens personliga förhållanden i övrigt. Systemet har kritiserats för att en patient därmed kan kvarhållas inom vården, även när den psykiska störningen inte längre anses existera.

I och med den inskränkning som tvångsvård innebär har individens rättigheter en central plats inom den svenska psykiatrirätten. Uppsatsens syfte har därmed varit att utreda hur rättspsykiatrisk vård med särskild utskrivningsprövning förhåller sig till Europadomstolens praxis om tvångsvård och frihetsberövande. Vidare har institutet med särskild utskrivningsprövning analyserats utifrån ett kritiskt rättighetsperspektiv. De rättigheter som är i fokus är de grundläggande fri- och rättigheterna som stadgas i regeringsformen, Europeiska konventionen om skyddet för de mänskliga rättigheterna samt FN:s konvention om rättigheter för personer med funktionsnedsättning. Uppsatsens slutsats är att särskild utskrivningsprövning kan kritiseras utifrån ett rättighetsperspektiv, då intresset av samhällsskydd tillgodoses på bekostnad av individens rättigheter. Uppsatsen lägger därmed fram en kritik avseende att rättspsykiatrisk vård med särskild utskrivningsprövning inte tillgodoser individens rättigheter enligt nämnda regelverk. (Less)
Abstract
The Swedish legal system contains a special treatment of mentally disturbed offenders in regards to the sanction. Instead of being sentenced to prison for example, there is a possibility for the court to sentence an individual to forensic psychiatric care. The forensic psychiatric care can be united with special discharge review, which is regulated in the Forensic Mental Care Act (1991:1129). This meaning that it is an administrative court (instead of a senior psychiatrist) who is responsible for investigating the issue of discharge. The administrative court can thereby exclude discharge if the patient is found to suffer a risk of relapse in criminal activity, or if continued psychiatric care is considered necessary due to the patient’s... The forensic psychiatric care can be united with special discharge review, which is regulated in the Forensic Mental Care Act (1991:1129). This meaning that it is an administrative court (instead of a senior psychiatrist) who is responsible for investigating the issue of discharge. The administrative court can thereby exclude discharge if the patient is found to suffer a risk of relapse in criminal activity, or if continued psychiatric care is considered necessary due to the patient’s personal circumstances. The system has been criticized for the fact that a patient can be detained within psychiatric care, even when the mental disease no longer exists.

Due to the restriction that compulsory mental health care constitutes, the individual’s rights have a fundamental position in the Swedish forensic psychiatri. The purpose of the essay has therefore been to examine how forensic psychiatric care with special discharge review relates to the judgements of the European Court of Human Rights regarding compulsory care and deprivation of liberty. Furthemore, the system of forensic psychiatric care with special discharge review has been analyzed from a critical rights perspective. The essay focuses on the freedoms and rights guaranteed in the Swedish constitution, the European Convention on Human Rights and The United Nations Convention on the Rights of Persons with Disabilities. The conclusion of the essay is that special discharge review can be criticized from a rights perspective, as the interest of civil protection is fulfilled at the expense of the individual’s basic rights and freedom. The essay therefore presents criticism regarding the fact that forensic psychiatric care with special discharge review does not meet the human rights the individual is guaranteed according to the legal framework mentioned.
