- De senaste åren har alltfler EU-medborgare, främst romer från Rumänien och Bulgarien, kommit till Sverige för att försörja sig på svenska gator och torg. I folkmun kallas de ”tiggare”, i svenska officiella dokument kategoriseras de som ”utsatta EU-medborgare”. Ungefär 100 av unionsmedborgarna som bor i utsatthet i Sverige är barn. Denna uppsats handlar om tillgången till hälso- och sjukvård för barn som är EU-medborgare och som lever i ekonomisk utsatthet i Sverige.
Såväl EU-rätt som svensk rätt studeras för att hitta möjligheter och hinder i det rättsliga regelverket kring den minderårigas rätt till vård. Såväl EU-rätt som svensk rätt studeras för att hitta möjligheter och hinder i det rättsliga regelverket kring den minderårigas rätt till vård. Därefter analyseras Sveriges skyldigheter att tillgängliggöra vård till minderåriga unionsmedborgare utifrån rätten till hälsa i FN:s konventionen om ekonomiska, sociala och kulturella rättigheter (ESK-konventionen) och i Barnkonventionen.
Majoriteten av unionsmedborgarna i ekonomisk utsatthet i Sverige har inte tillgång till det europeiska sjukförsäkringskortet. Denna uppsats kommer visa att de juridiska möjligheterna till (subventionerad) vård för den oförsäkrade är få. Problemen beror till stor del på att varje stat inom EU har rätt att utforma villkoren för sitt eget hälso- och sjukvårdssystem.
Sverige har en möjlighet att utforma sitt hälso- och sjukvårdssystem så att även den minderåriga unionsmedborgaren får tillgång till subventionerad vård. Med det sagt så kommer denna uppsats till slutsatsen att Sverige inte har en skyldighet att vidta sådana åtgärder, eftersom staten uppfyller sina åtaganden enligt rätten till hälsa i ESK-konventionen och i Barnkonventionen. - In recent years Sweden have seen an increase in the number of EU citizens, mainly from Romania and Bulgaria, that make their living by begging on the streets. In official Swedish documents they are referred to as vulnerable EU citizens. About a hundred of them are believed to be under the age of 18. The purpose of this essay is to examine vulnerable EU citizen children’s access to healthcare in Sweden from a legal perspective. The overarching aim is achieved by discussing relevant national and EU-regulation, as well as analyzing the scope of Sweden’s obligations under the right to health in the International covenant of economic, social and cultural rights (ICESCR) and in the Covenant on the rights of the child.

The majority of children coming to Sweden together with their families to support themselves in street environments are not covered by a European Health Insurance. The essay finds that these children have few legal possibilities for gaining access to (subsidized) healthcare in Sweden. The problems are largely due to the fact that each EU state has the right to design the conditions for its own health care system.
Sweden have the possibility to provide EU citizens that are minors and are living in economic vulnerability, with access to subsidized healthcare. With that being said, this essay concludes that Sweden are under no obligation to take such measures, as the state already fulfils its obligations under ICESCR and Convention on the rights of the child.
