- En ökad mångfald kan leda till att religiösa frågor i arbetslivet får en ökad aktualitet och att en individs rättigheter och krav då ställs mot arbetsgivarens verksamhetsintresse och dennes rätt att leda och fördela arbetet. En arbetstagares vägran att utföra en viss arbetsuppgift på grund av religion eller samvete måste då vägas mot arbetsgivarens arbetsledningsrätt och andra eventuellt motstående intressen.
Religions- och samvetsfriheten som mänsklig rättighet skyddas under såväl internationell som nationell rätt. Den individuella tron är absolut och okränkbar, men själva manifestationen kan begränsas. Religions- och samvetsfriheten som mänsklig rättighet skyddas under såväl internationell som nationell rätt. Den individuella tron är absolut och okränkbar, men själva manifestationen kan begränsas. Vidare finns även lagstiftning som skyddar individen från, att på grund av sin religion eller övertygelse, diskrimineras i arbetslivet.
Syftet med uppsatsen är att undersöka när en arbetstagare kan vägra att utföra vissa arbetsuppgifter med hänsyn till sin religion och om det är arbetsledningsrätten eller arbetstagarens religionsfrihet som väger tyngst i domstolarnas intresseavvägning. Undersökningen visar att individens rättighet att manifestera sin religion oftast får ge vika för arbetsgivarens verksamhetsintresse och en utomstående tredje mans motstående intressen. Arbetsledningsrätten är stark, att arbetsvägra är inte tillåtet och kan utgöra saklig grund för uppsägning. Praxis visar att ingå en anställning kan medföra en begränsning av möjligheten att utöva sin religion och då står det arbetstagaren fritt att själv avsluta anställningen (Less) - Abstract

An employee’s refusal to perform a duty, based on religious or conscientious beliefs, must then be weighed against the employer’s managerial rights and other possible conflicting interests.
Freedom of religion and conscientious beliefs, as fundamental human rights, are protected under both international and national legislation. Whereas the individual’s personal beliefs are absolute and inviolable, the actual manifestation can be restricted. Furthermore there is legislation that protects the individual from discrimination based on religion and conscience at work.
The purpose of this bachelor thesis is to examine wether an employee can refuse to perform certain assignments with regards to his or her religion and if it is the employer’s managerial rights or the employee’s freedom of religion that take precedence in the courts’ balancing of interests. The analysis shows that the employer’s and other external interests almost always supersede an individual’s right to manifest his or her religion. Court practice shows that the employer’s managerial rights are strong and a refusal to work may result in the termination of employment. Entering into employment may limit the individual’s ability to manifest their religion and the employee can then choose to accept the limitation or voluntarily end the employment. (Less)
