Den svenska arbetsmarknadsmodellen bygger på ett samarbete och samförstånd mellan arbetsmarknadens parter. Deras arbete ligger i att komma överens om lösningar på arbetsmarknadsrelaterade problem, utan inblandning av staten och utan att staten lagstiftar på området. Detta kallas för den svenska modellen, som mycket baseras på framförhandlade kollektivavtal. Kollektivavtal har en bindande verkan mellan de avtalstecknande parterna och är gällande som en rättskälla. Dessa avtal innebär att fredsplikt föreligger mellan de avtalsbundna parterna enligt lag, vilket då också begränsar möjlighet till stridsåtgärder. Den svenska arbetsmarknadsmodellen bygger på ett samarbete och samförstånd mellan arbetsmarknadens parter. Deras arbete ligger i att komma överens om lösningar på arbetsmarknadsrelaterade problem, utan inblandning av staten och utan att staten lagstiftar på området. Detta kallas för den svenska modellen, som mycket baseras på framförhandlade kollektivavtal. Kollektivavtal har en bindande verkan mellan de avtalstecknande parterna och är gällande som en rättskälla. Dessa avtal innebär att fredsplikt föreligger mellan de avtalsbundna parterna enligt lag, vilket då också begränsar möjlighet till stridsåtgärder. I 2019 kom där dock nya regler angående stridsrätten som begränsar den ytterligare. Till skillnad från tidigare blir fredsplikt nu direkt tillämplig på de arbetstagarorganisationer utan kollektivavtal, men som har medlemmar hos en arbetsgivare. De nya reglerna uppkom i ljuset av en lång konflikt som pågått i Göteborgs containerhamn där arbetsmarknadens parter inte lyckats komma till samförstånd och kunnat enas. Kritiken mot införandet av dessa nya regler har varit hård, både under lagstiftningsprocessen och efteråt, då de inte anses tillräckligt genomtänkta. Det anses inte heller ha lagts tillräckligt djupa reflektioner kring hur de kan komma att påverka andra aktörer på den svenska arbetsmarknaden i framtiden. Stridsrätten är en lagstadgad rättighet som här inskränks, samt gör det svårare för oetablerade fackförbund utan kollektivavtal att få igenom villkor för sina medlemmar. De nya reglerna kan få motsatt effekt och påverka de etablerade fackförbunden om en arbetsgivare väljer att teckna kollektivavtal med ett oetablerat fackförbund med för arbetsgivaren billigare villkor. The Swedish labour market is set to work through an understanding and consensus between the social partners, both on the employee and the employer side. The social partners are supposed to come to agreements on labour market related issues, without any intervention from the government in forms of legislations. This is called The Swedish Model, and is also based on by the social partners negotiated collective agreements. Collective agreements are binding according to the law, and are to be seen as a legal source. The collective agreements are also to be seen as a peace document between the parties bound to an agreement, according to The Codetermination Act’s 41 §. The social partners are supposed to come to agreements on labour market related issues, without any intervention from the government in forms of legislations. The collective agreements are also to be seen as a peace document between the parties bound to an agreement, according to The Codetermination Act’s 41 §. However, in 2019 there were new regulations put in place in The Codetermination Act, by the government, regarding industrial actions. These new regulations are related to a long lasting conflict in the harbour of Gothenburg, which the social partners could not resolve on their own. Being related to this conflict, the new regulations got a lot of criticism during the legislation process, and still do, for not having been well thought through or cared for with deeper reflection on how they will affect the different parties on the Swedish labour market in the future. Also, it now means that an employer could choose a collective agreement with a minority trade union with, for the employer, cheaper regulated terms in it. And without other trade unions to be able to react on it. (Less)
