Till mitt försvar - En studie om försvarlighetsbedömningar vid förtal på sociala medier

Denna uppsats ämnar undersöka, analysera och diskutera försvarlighetsbedömningar vid förtal enligt brottsbalken. Uppsatsen söker svaret på hur bedömningen går till samt hur den bör gå till. Undersökningen är begränsad till att omfatta förtal begångna på sociala medier då någon blivit utpekad som brottsling. Uppsatsen avhandlar även aspekten vad som är relevant vid en försvarlighetsbedömning vid förtal inom dolda privata grupper på Facebook.

Undersökningen är begränsad till att omfatta förtal begångna på sociala medier då någon blivit utpekad som brottsling. Uppsatsen avhandlar även aspekten vad som är relevant vid en försvarlighetsbedömning vid förtal inom dolda privata grupper på Facebook.

Den metod som använts i arbetet med uppsatsen är den rättsdogmatiska metoden. För att utröna gällande rätt har främst lagtext och praxis beaktats. För att närmare undersöka domstolarnas tillämpning av förtalsbestämmelsen vid brott begångna på sociala medier har tre domar från tingsrätterna analyserats.

Domstolarna ser allvarligt på namngivning av personer på sociala medier. I samtliga tre fall som analyseras har den tilltalade fällts för grovt förtal. Vid bedömningen av försvar- lighet läggs stor vikt vid hur många som nåtts av den spridda uppgiften. Ytterligare en viktig faktor i bedömningen är huruvida den tilltalade kunnat nyttja sin yttrandefrihet på ett för målsäganden mindre integritetskränkande sätt. Domstolarna fäster även stor vikt vid vilken relation den tilltalade hade till den krets till vilken uppgiften spreds.

Utifrån domstolarnas resonemang tål det att ifrågasättas huruvida de till fullo accepterat premissen att under prövningen av försvarlighet beakta de spridda uppgifterna som fullt ut sanna.
Yttrandefriheten hamnar i bedömningen om försvarlighet i bakgrunden. Domstolarna prövar enträget om den krets till vilken uppgifterna spreds kan utgöra en förtrolig krets. När så inte är fallet sker i regel ingen djupare diskussion kring huruvida det ändå kan an- ses försvarligt med beaktade av andra omständigheter. (Less)
Abstract
This paper investigates, analyzes and discusses defense assessments in slander cases, as defined by the Swedish Penal Code. It looks at how assessments currently proceed rela- tive to how they could potentially be handled differently. This survey is limited to cover- ing slander committed on social media when someone has been singled out as a criminal. Our thesis also addresses what is relevant in a slander defense assessment for hidden private discussion groups on Facebook.

This paper solely uses the formal dogmatic approach. The author have primarily consid- ered legal texts and general practice to determine what current laws apply. Three judg- ments by district courts have been reviewed in investigating the application of the court’s... (More)
This paper investigates, analyzes and discusses defense assessments in slander cases, as defined by the Swedish Penal Code. It looks at how assessments currently proceed rela- tive to how they could potentially be handled differently. This survey is limited to cover- ing slander committed on social media when someone has been singled out as a criminal. Our thesis also addresses what is relevant in a slander defense assessment for hidden private discussion groups on Facebook.

Three judg- ments by district courts have been reviewed in investigating the application of the court’s defamation provision for crimes committed on social media.

The courts take seriously the naming of people on social media. In all three of the ana- lyzed cases, the accused was convicted of grave defamation. The law places significant emphasis on the number of recipients that were able to receive the given information. Another important factor in the assessment can be whether the accused could have used their freedom of expression in a manner that is less of a violation to the privacy of the plaintiff. The courts also place great importance on what relationship the defendant had to the social circle to which the information was spread.

On the basis of the ruling of the courts, it can be questioned whether the courts fully accepted the premise that the distributed information was indeed factual.

Freedom of expression underpins the assessment of the defense. The courts typically attempt to prove definitively if the social circle to which the information was distributed can constitute a confidential group. When this is not the case, no further discussion is had normally as to whether it can still be considered justifiable, taking into account other circumstances. (Less)
