Offentlighetsprincipen är en grundläggande princip för Sveriges statsskick, som grundar sig på ett vertikalt förhållande mellan stat och individ. Principens syfte är att upprätthålla demokratin genom allmänhetens och mediernas möjlighet att få insyn i de offentliga organens verksamhet. Huvudförhandlingar, kallad rättegångar, vid domstolar, är som huvudregel offentliga. Likaså är offentlighet, i de allra flesta fall, en huvudregel vid utlämnande av myndighetshandlingar, såsom domar och beslut. Insyn i förvaltningar och myndigheter har bedömts vara angelägenheter som bör omfattas av offentlighetsprincipen. Offentlighetsprincipen är en grundläggande princip för Sveriges statsskick, som grundar sig på ett vertikalt förhållande mellan stat och individ. Principens syfte är att upprätthålla demokratin genom allmänhetens och mediernas möjlighet att få insyn i de offentliga organens verksamhet. Huvudförhandlingar, kallad rättegångar, vid domstolar, är som huvudregel offentliga. Likaså är offentlighet, i de allra flesta fall, en huvudregel vid utlämnande av myndighetshandlingar, såsom domar och beslut. Insyn i förvaltningar och myndigheter har bedömts vara angelägenheter som bör omfattas av offentlighetsprincipen. Lagstiftaren har satt offentlighetsprincipens funktionalitet i förhållande till andra skyddsvärda intressen, varpå avvägningar görs mot den personliga integriteten genom OSL, i vilken dataskyddsförordningen och andra integritetsreglerande lagar är sammanvävda i.

Genom yttrandefrihetsgrundlagen finns det sedan år 2003 en möjlighet för enskilda och juridiska personer att köpa ett frivilligt utgivningsbevis. Enligt rådande rättsläge behöver inte databaser med ett frivilligt utgivningsbevis följa vare sig OSL eller dataskyddsförordningen trots att en personuppgiftsbehandling sker. Databaser kan därför med stöd av utgivningsbevis behandla och ge ut personuppgifter på internet om enskildas brottmålsdomar och lagöverträdelser.

Utlämnade domar från allmän domstol, utifrån offentlighetsprincipen, ger ett bredare skydd för personuppgifter, och den personliga integriteten, än domar utgivna av databaser med grundlagsskydd utifrån yttrandefrihetsgrundlagens bestämmelser, även fast domar samt personuppgifter vilka behandlas däri, är inhämtade på offentlighetsprincipens grund. The principle of public access to information is a vertical fundamental relationship between the state and individual. The purpose of the principle is to maintain democracy. The public and the mass media have access to meetings of decision-making assemblies, and are entitled to attend trials the chamber of the swedish parliament, the municipal assembly, county council assembly and other such bodies. In principle, all Swedish citizens and aliens are entitled to read the documents held by public authorities. Public access to information is the ground rule but transparency in administrations and authorities is also judged to be matters that should be covered by the principle of publicity. The principle of public access to information is a vertical fundamental relationship between the state and individual. The purpose of the principle is to maintain democracy. The public and the mass media have access to meetings of decision-making assemblies, and are entitled to attend trials the chamber of the swedish parliament, the municipal assembly, county council assembly and other such bodies. In principle, all Swedish citizens and aliens are entitled to read the documents held by public authorities. Public access to information is the ground rule but transparency in administrations and authorities is also judged to be matters that should be covered by the principle of publicity. The legislature has set the principle of public access to information in balance to other interests worthy of protection, for example, the right to privacy and protection of personal data. This is regulated in The Public access to information and secrecy act and the data protection regulation, which public courts are to follow when they process personal data and gives out judgements on the basis of the principle of public access to information.

By the protection for freedom of expression in radio, TV, films, videograms and sound recordings etc, which is regulated in the fundamental law on freedom of expression from the year of 2003, which is based on the same principles as the freedom of the press act, databases provide information on and judgements of individuals, to other individuals. This can be done by buying a voluntary release certificate. According to the legal situation today, databases with a voluntary certificate of release, which collects judgements from the public courts on the bases of the principle of public access to information, do not have to comply with either The Public access to information and secrecy act or GDPR while processing personal data. Databases can therefore process and publish personal data on the internet with regard to individuals' criminal convictions and offenses, no matter of the purposes of the laws and principles that provides the right.
