Sabotage mot blåljusverksamhet - En kartläggning av det nya brottet

Den 1 januari 2020 infördes bestämmelsen om sabotage mot blåljusverksamhet i brottsbalken. Med blåljusverksamhet avses polisen, räddningstjänsten och ambulanssjukvården. Det har runtom i landet skett olika typer av angrepp riktade mot blåljusverksamheten, bland annat stenkastning. Syftet med bestämmelsen är att skapa ett heltäckande skydd för blåljusverksamheten, då den har en viktig samhällsfunktion.
Uppsatsens syfte är att kartlägga och analysera rättstillämpningen av det nya brottet. Den 1 januari 2020 infördes bestämmelsen om sabotage mot blåljusverksamhet i brottsbalken. Med blåljusverksamhet avses polisen, räddningstjänsten och ambulanssjukvården. Det har runtom i landet skett olika typer av angrepp riktade mot blåljusverksamheten, bland annat stenkastning. Syftet med bestämmelsen är att skapa ett heltäckande skydd för blåljusverksamheten, då den har en viktig samhällsfunktion.
Uppsatsens syfte är att kartlägga och analysera rättstillämpningen av det nya brottet. I uppsatsen studeras särskilt begreppen utryckningsverksamhet och brottsbekämpande verksamhet samt det kvalificerade rekvisitet allvarligt försvåra eller hindra. Denna studie har genomförts med stöd av förarbetena till bestämmelsen och domar som har meddelats om bestämmelsen fram till den 1 december 2020.
Bestämmelsen är utformad i en uppdelning mellan utryckningsverksamhet och brottsbekämpande verksamhet. Kartläggningen av domarna har visat att de flesta gärningar som har tagits upp i domarna har riktats mot polisen eller polisens hjälpmedel. Polisverksamheten delas upp i utryckningsverksamhet och brottsbekämpande verksamhet. Det gör att betydelsen av vilken typ av verksamhet som gärningen riktar sig mot är stor. I de flesta domarna har gärningen ansetts vara riktad mot den brottsbekämpande verksamheten.
Förutom att gärningen antingen ska riktas mot utryckningsverksamhet eller brottsbekämpande verksamhet ska gärningen vara ägnad att allvarligt försvåra eller hindra en sådan verksamhet. I propositionen till bestämmelsen har det angetts att vid bedömningen av gärningens allvarlighet ska man titta på angreppets karaktär och vilken verksamhet det är. Det får därför stor betydelse om gärningen anses vara riktad mot utryckningsverksamhet eller brottsbekämpande verksamhet. Beroende på vilken typ av verksamhet som gärningen påverkar, ställs det i propositionen upp olika krav för gärningens allvarlighet. Det krävs en lägre grad av påverkan när en gärning är riktad mot utryckningsverksamhet.
Kartläggningen har visat att inom begreppet brottsbekämpande verksamhet ryms många händelser av skild karaktär. Eftersom det skapas en stor bredd på olika situationer som polisens brottsbekämpande verksamhet omfattas av, kan det ifrågasättas om alla dessa situationer ska omfattas av högre krav. Frågan är hur väl detta överensstämmer med bestämmelsens syfte om ett heltäckande skydd för blåljusverksamheten. (Less)

The first of January 2020 the regulation about sabotage of emergency service activities was introduced in the Swedish Criminal Code. Emergency service activities refers to the police, rescue service and ambulance care. All over the country there have been different types of attacks directed at the emergency service activities, among other things stone-throwing. Emergency service activities refers to the police, rescue service and ambulance care. All over the country there have been different types of attacks directed at the emergency service activities, among other things stone-throwing. The purpose with the regulation is to create a total protection for the emergency service activities, because of its important function in society.
The purpose of the paper is to survey and analyse the application of the law of the new crime. The paper especially studies the concepts emergency response activities and law enforcement activities as well as the qualified necessary condition seriously aggravate or obstruct. This study has been carried out with support from the legislative history to the regulation and judgments that have been passed about the regulation until the first of December 2020.
The regulation is designed as a division between emergency response activities and law enforcement activities. The survey has shown that most of the acts that have been brought up in the judgments have been directed against the police or the police aid. The police activity is divided between emergency response activities and law enforcement activities. It makes the importance of which type of activity that the act is directed at big. In most of the judgments the act has been considered directed against the law enforcement activities.
Apart from the act being directed either against emergency response activities or law enforcement activities the act should be calculated to seriously aggravate or obstruct such activity. In the government bill to the regulation it has been stated that in the assessment of the seriousness of the act you should look at the character of the attack and which activity it is.
Therefore it is of great importance if the act is considered to be directed at emergency response activities or law enforcement activities. Depending on which type of activity the act influences, the government bill puts up different requirements for the seriousness of the act. It requires a lesser degree of influence when an act is directed against emergency response activities.
The survey has shown that the concept law enforcement activities holds a lot of events of different character. Seeing that it creates a big width on different situations that the law enforcement activities of the police is included by, it can be questioned if all these situations should be included by higher requirements. The question is how well this agrees with the purpose of the regulation to create a total protection for the emergency service activities. (Less)
