"En svensk parodi" - En rättsutvecklingsanalys av det så kallade parodiundantaget i svensk upphovsrätt

Denna rättsvetenskapliga uppsats har till syfte att undersöka och analysera rättsutvecklingen av det så kallade parodiundantaget i svensk upphovsrätt. Utvecklingen av det svenska parodiundantaget har i den senaste svenska rättspraxisen från 2019 och 2020 ställts på sin spets på grund av inflytandet av ett europeiskt utvecklat parodiundantag. Undantagets dynamiska natur inom ett snabbt utvecklande rättsområde kan ge upphov till oklarheter. Uppsatsen ämnar att belysa tre aspekter i rättsutvecklingen för att sedan analysera praktiska konsekvenser och skillnader som uppstår då en traditionell hantering av parodier anpassas till ett europeiskt synsätt.

Utvecklingen av det svenska parodiundantaget har i den senaste svenska rättspraxisen från 2019 och 2020 ställts på sin spets på grund av inflytandet av ett europeiskt utvecklat parodiundantag. Undantagets dynamiska natur inom ett snabbt utvecklande rättsområde kan ge upphov till oklarheter. Uppsatsen ämnar att belysa tre aspekter i rättsutvecklingen för att sedan analysera praktiska konsekvenser och skillnader som uppstår då en traditionell hantering av parodier anpassas till ett europeiskt synsätt.

Dessa tre aspekter är: det traditionella svenska synsättet på det så kallade parodiundantaget, det europeiskt framvuxna parodiundantaget och slutligen en analys av den senaste svenska praxisen där dessa två synsätt har kommit att kombineras. Inom ramen för uppsatsens analys kommer skillnader och likheter mellan dessa två parodiundantag jämföras, samt en analys av de potentiella praktiska tillämpningskonsekvenser som kan uppstå när ett svenskt synsätt på parodier ställs mot EU-rättens reglering och praxis. Två sådana konsekvenser är det europeiska parodiundantagets icke-existerande originalitetskrav på parodiverket, en stark kontrast till det traditionella svenska synsättet, samt följden av att ett allmänt svenskt parodiundantag får en tydligare inskränkningsfunktion i upphovsrätten. The purpose of this study is to investigate and analyze the legal development of the so-called parody exception in Swedish copyright law. In the most recent Swedish case law from 2019 and 2020, the applicability of the Swedish parody exemption has been directly questioned due to its influence of a European-developed parody exemption. The purpose of this study is to investigate and analyze the legal development of the so-called parody exception in Swedish copyright law. In the most recent Swedish case law from 2019 and 2020, the applicability of the Swedish parody exemption has been directly questioned due to its influence of a European-developed parody exemption. This essay intends to analyze the legal development of the exception by looking at three different aspects, or significant turning points, which have developed the Swedish parody exception from a traditional general exemption into a European-bred restriction.
These three aspects are: The traditional Swedish approach to the so-called parody exception, the European developed parody exception and finally an analysis of the latest Swedish case law where these two approaches have been practically combined. Within the framework of the thesis’ analysis, differences and similarities within these two parody exceptions will be compared, as well as an analysis of the potential practical consequences that may arise when a Swedish approach to parodies established in practice is directly questioned by a European approach. Two such consequences arising are the European non-existent requirement of originality in relation to the parody itself, a principle which the Swedish exemption was built on, and the consequence of a general Swedish parody exemption developing a clearer restriction based functionality in Swedish copyright law.
