Abstract
Public procurement is a large area of law that plays an important part in todays society. Public procurement turns over billions of Swedish kronor annually and employs lots of people. The Swedish legislation on public procurement derives from the union law that Sweden became a part of in connection with joining the European Union in the beginning of the 1990’s. Public procurement is regulated by a catalogue of directives on EU level. The union law focuses, however on procurement of larger value, the so-called directive-controlled area.
Public procurement outside of the directive-controlled area, or under the threshold amounts decided by the European Commission, is not regulated by union law but instead by national legislation. Direct... (More)
Public procurement is a large area of law that plays an important part in todays society. Public procurement turns over billions of Swedish kronor annually and employs lots of people. The Swedish legislation on public procurement derives from the union law that Sweden became a part of in connection with joining the European Union in the beginning of the 1990’s. Public procurement is regulated by a catalogue of directives on EU level. The union law focuses, however on procurement of larger value, the so-called directive-controlled area.
Public procurement outside of the directive-controlled area, or under the threshold amounts decided by the European Commission, is not regulated by union law but instead by national legislation. Direct procurement is one of the procedures that Swedish contracting authorities can use for procurements outside of the directive-controlled area. Direct procurement allows procurements to be done without demands that tenders should be made in a certain way, for example oral agreements or buys over counter. Direct procurement is a procedure not influenced by as many rules and demands as the regular public procurement, this because it is meant as a way for contracting authorities to be able to make smaller purchases without extensive bureaucracy.
The essay examines direct procurement from a de lege lata-perspective with focus on the origins and purposes of the rules. The essay also reviews the possibility for contracting authorities to make direct procurements with the motive that it was in so-called extreme urgency (synnerlig brådska). An argument that is not uncommon in the courts. (Less)

Offentlig upphandling är ett stort rättsområde som spelar en viktig roll i samhället. Offentlig upphandling omsätter miljardbelopp årligen och sysselsätter otroligt många människor. Den svenska lagstiftningen kring offentlig upphandling utgår ifrån den unionsrätt som Sverige blev en del av i samband med inträdet i EU i början av 1990-talet. Offentlig upphandling regleras på EU-nivå av en katalog av olika direktiv. Unionsrätten fokuserar dock på upphandlingar av större värde, det så kallade direktivstyrda området.

Den svenska lagstiftningen kring offentlig upphandling utgår ifrån den unionsrätt som Sverige blev en del av i samband med inträdet i EU i början av 1990-talet. Direktupphandling är ett av de upphandlingsförfaranden som svenska upphandlande myndigheter kan använda sig av vid upphandlingar utanför det direktivstyrda området. Direktupphandling innebär att upphandlingar kan utföras utan krav på anbud i särskild form, till exempel genom muntligt avtal eller köp över disk i butik. Direktupphandling är ett förfarande som inte är influerat av så många regler och krav som den ordinarie offentliga upphandlingen, detta eftersom det är tänkt som ett sätt för upphandlande myndigheter att kunna göra mindre inköp utan en massa byråkrati.
Uppsatsen undersöker direktupphandling ur ett de lege lata-perspektiv med fokus på reglernas ursprung och syfte. Uppsatsen granskar också möjligheten för upphandlande myndigheter att genomföra direktupphandlingar med motivet att myndigheten råkat i så kallad synnerlig brådska. En argumentation som inte är alls ovanligt förekommande i domstol. (Less)
