- Denna uppsats behandlar företrädesrätt till återanställning och hur den påverkas av möjligheten att hyra in arbetskraft. Syftet med uppsatsen är att undersöka hur företrädesrätten regleras, huruvida inhyrning av arbetskraft kan vara ett kringgående av lagen samt hur företrädesrätten påverkas av inhyrning av arbetskraft. För att uppnå detta används en rättsdogmatisk metod. Företrädesrätt till återanställning är en del av det lagstadgade anställningsskyddet och syftar till att arbetstagare som blivit uppsagda på grund av arbetsbrist ska få förtur till nya anställningar hos arbetsgivaren.

I den här uppsatsen konstateras att ett kringgående av företrädesrätten kan föreligga om arbetsgivaren har handlat otillbörligt, haft syfte att kringgå företrädesrätten eller om arbetsgivaren saknat saklig grund för att inte erbjuda återanställning till företrädesberättigade arbetstagare. Företrädesrätten som regleras i 25–27 §§ i lagen (1982:80) om anställningsskydd samt i kollektivavtal är inte någon garanti för återanställning. Inhyrning av arbetskraft ses sällan som ett kringgående av företrädesrätten enligt Arbetsdomstolens praxis, då det är arbetsgivaren som bestämmer hur verksamheten ska organiseras. Arbetsgivaren väljer om arbetskraftsbehovet ska tillgodoses genom ny anställning eller inhyrning. Det är endast vid ny anställning som företrädesrätten kan tas i anspråk. Företrädesrättens ställning har försvagats till följd av prejudicerande domar och pågående förändringar på arbetsmarknaden. (Less) - Abstract
- This paper examines the priority right to re-employment and how it is affected by the possibility to hire temporary workers. The purpose is to investigate the regulation of the priority right to re-employment; whether hiring of temporary workers can be considered a circumvention of the law; and how the practice of hiring temporary workers impacts the priority right. This is achieved by using a legal dogmatic method. The priority right to re-employment is a part of the statutory employment protection, and the intention is to give priority to employees who have been dismissed due to redundancy in cases of new employment.

The purpose is to investigate the regulation of the priority right to re-employment; whether hiring of temporary workers can be considered a circumvention of the law; and how the practice of hiring temporary workers impacts the priority right. This is achieved by using a legal dogmatic method. The priority right to re-employment is a part of the statutory employment protection, and the intention is to give priority to employees who have been dismissed due to redundancy in cases of new employment.
This paper finds that a circumvention of the priority right requires an unlawful procedure by the employer or that the employer has a reason to circumvent the law. It can also be considered a circumvention if an employer fails to provide a just cause for their decision not to re-employ a former employee with priority right. The priority right is regulated in sections 25–27 in the Employment Protection Act (1982:80) and in collective agreements, however re-employment is not a guarantee. The practice of hiring temporary workers is rarely seen a circumvention of the priority right, according to case law; since it is the employer who makes decisions about the economic aspects of the organization. The employer decides whether to hire temporary workers or to re-employ former employees in a new employment. The priority right is only applicable in cases of new employment. The status of the priority right has diminished because of precedents from the Swedish Labour Court, and the ongoing changes on the labour market. (Less)
