Abstract
The purpose of this study was to examine the thoughts and experiences of children’s investigators of the social services regarding the recent incorporation of the UN Convention on the Rights of the Child (UNCRC) into Swedish domestic law. By doing so we wished to gain a greater understanding of the practical implications of this new law. The purpose of this study was to examine the thoughts and experiences of children’s investigators of the social services regarding the recent incorporation of the UN Convention on the Rights of the Child (UNCRC) into Swedish domestic law. By doing so we wished to gain a greater understanding of the practical implications of this new law. Our method was qualitative and the data collected through semi-structured interviews with six children’s investigators in five Swedish municipalities, chosen mainly through a snowball sampling. A thematic approach was used for analyzing the data, together with the theoretical approaches of organizational culture and the professional space – the discretion – in which children’s investigators are able to operate. The study found that the interviewee s had not noticed a great difference in their everyday work as a result of this new law. They still face the same dilemmas when it comes to taking the child's best interest into primary consideration. The reasons identified included the fact that the UNCRC already is part of the organizational culture of their workplaces and that the incorporation of the UNCRC into Swedish law is part of a societal development in which children’s rights are valued to a greater extent. The interviewees expressed hope regarding the possible effect of the new law on other functions of society, such as courts, which could have a considerable impact on children’s lives. Furthermore, challenges regarding the practical impact of this new law on children’s rights were identified – the most prominent ones being the vagueness of the convention’s language and the strong rights of biological parents concerning their children according to Swedish law.
