Abstract
The conflict between the Sami people on one hand and the majority of Sweden on the other has a long history, and one of the main topics in this conflict concerns the use of territory in the parts of Sweden where the Sami people conduct reindeer herding.
In 2009 a small reindeer herding community called Girjas sued the Swedish government as they considered themselves being entitled to have the exclusive right to fish and hunt, as well as management of issuing fishing and hunting permits, in the area where they herd reindeers.
In 2020 the Swedish supreme court granted the Girjas community that right based on the fact the Sami people have used the territory for time immemorial.

This thesis examines the arguments put forward in the Swedish supreme court in order to analyze if it is possible, through liberal political theory, to justify the right the Girjas community has acquired.
The liberal theory perspective has been chosen for this study based on the fact that group-rights and positive actions for minorities in order to raise the equality level in a community has been a question of debate among liberal thinkers during the years. Partly due to the reason that the whole idea of offering special treatments to a few tends to collide with the basic liberal principle that everybody in a community should be treated equally. (Less)
