Hur dum får man vara? – Om domstolarnas bedömningar om vad tilltalad insåg om målsägandens frivilliga deltagande vid oaktsam våldtäkt

- Syftet med denna uppsats är att undersöka tillämpningen av oaktsam våldtäkt, 6 kap 1a § BrB, utifrån ett rättssäkerhetsperspektiv. Först genom att undersöka det nya brottets uppbyggnad och struktur utifrån förarbeten och lagtext, därefter genom att se hur brottets tillämpats i praktiken.
Det nya brottet oaktsam våldtäkt instiftades i svensk lag den 1 juli 2018. Första gången brottet diskuterades på utredningsnivå var vid 2008 års sexualbrottsutredning. Först i 2014 års betänkande av sexualbrottskommittén föreslogs ett införande av oaktsamhetsrekvisitet. I förarbetena till det nya brottet anges vissa riktlinjer kring hur oaktsamhetsbedömningen ska gå till. Mycket lämnas dock till rättstillämpningen att utröna, vilket kritiserats utifrån en rättssäkerhetssynpunkt.
Rättsfallsanalysen visar att rättstillämpningen inte alltid är enhetlig. Domstolarna ställer delvis olika krav på tilltalads aktsamhet, och landar i olika slutsatser kring när frågeskyldigheten inträder. Analysen visar också att domstolarna utgår från olika normer i bedömningen av medveten oaktsamhet – i vissa fall tilltalads egna föreställningar av hur sexuellt intresse kommer till uttryck, i andra fall andra normer. Utifrån detta konstateras att det finns vissa brister i rättstillämpningens förutsägbarhet. (Less) - Abstract
- The purpose of this thesis is to examine negligent rape in chapter 6 section 1 of the Swedish Criminal Code (brottsbalken, SFS 1962:700) from a legal security perspective. First by examining how the legislator described the requirement in the legislative history and in the text of the law, thereafter by examine how the law has been applied in practice.
The new crime of negligent rape was instituted in Swedish law on 1 July 2018. The crime was first discussed at the investigational level in the sexual crime investigation of 2008 (2008 års sexualbrottsutredning). It was not before the Sexual Offenses Committee (sexualbrottskommittén) in 2016 that negligent rape was proposed as criminal offense.
Prior to the introduction, some raised... First by examining how the legislator described the requirement in the legislative history and in the text of the law, thereafter by examine how the law has been applied in practice.
The new crime of negligent rape was instituted in Swedish law on 1 July 2018. The crime was first discussed at the investigational level in the sexual crime investigation of 2008 (2008 års sexualbrottsutredning). It was not before the Sexual Offenses Committee (sexualbrottskommittén) in 2016 that negligent rape was proposed as criminal offense.
Prior to the introduction, some raised concerns regarding that the new crime would not take people's different sexual preferences into sufficient account. Worries were that it would be a way to avoid intentional crime.
In the preparatory work for the new crime, certain guidelines are stated regarding the assessment of negligence assessment. A lot is left for the adjudication process to decide, which has been critized from a legal security perspective.
The case analysis shows that the application of law is not always uniform. For example, the courts set different requirements for the defendant's carefulness. The analysis also shows that the courts use different norms in the assessment of deliberate negligence – in some cases the defendant's own ideas of how sexual interest is expressed, in other cases other standards of care. Based on this, there are deficiencies regarding the predictability in the application of law. (Less)
