Uppsatsen undersöker praxis som rör private enforcement (möjligheten till civilrättsligt skadestånd för en privat aktör för överträdelse av konkurrensrätten) i Sverige. Detta görs genom att studera de rättsfall som har hanterats av svenska domstolar, samt genom att se till de viktigaste rättsfallen inom EU-rätt. I en analys av detta ser man att området är outforskat i svensk praxis med få rättsfall och där många av dem slutat i avskrivning, eller i att kärande förlorat tvisten. Konkurrensskadelagen (2016:964) som tillkom 2016 har ännu inte påverkat svensk praxis. På många sätt är EU-praxis mer vägledande på området än den svenska praxisen är. Med tiden har praxisen rört sig mot att öppna upp för att fler skadelidande kan få ersättning, om än att detta beror på EU:s avgöranden. En anledning till att private enforcement inte har haft en stark utveckling med tiden i Sverige är att området saknar rättskultur, samt att reglerna är komplicerade och judiciella processen likaså. This essay studies case law regarding private enforcement (the possibility to seek repairs for damages caused by infringing on competition law) in Sweden. To do this, both national cases from Swedish courts and cases from the Court of Justice of the European Union has been studied. The result of the study is that Swedish case law is lacking cases, and that the subject is not well explored in Sweden. The few cases that exist most often end in either a defeat for the plaintiff or the parties settling. It is also common that the lawsuit is written off before a main hearing even takes place. The European Union’s case law is more established and there are clearer precedents. This is probably due to the European Union having a more established legal culture regarding private enforcement than Sweden has, and due to the somewhat complicated rules and practices regarding the judicial procedure in Sweden. The legal precedents have evolved though, if mostly due to the direct effect of the EU:s decisions. There is a trend of widening private enforcement so that it is easier to get reimbursed for damages, though this is mostly the case when applying EU-precedents. (Less)
