- The Swedish labour market is undergoing structural changes as a result of technological and demographic developments. New skill requirements are constantly emerging and the demand for skills development is increasing. The supply of highly skilled labour is becoming increasingly crucial for the competitiveness of the employer. Possessing the right skills is at the same time of significant importance for the individual employee’s employability and job security.
For all these reasons, the inquiry into Sweden’s Employment Protection Act (SOU 2020:30) proposes that all employers should be obliged by law to offer reasonable skills development to employees. (More) - The Swedish labour market is undergoing structural changes as a result of technological and demographic developments. New skill requirements are constantly emerging and the demand for skills development is increasing. The supply of highly skilled labour is becoming increasingly crucial for the competitiveness of the employer. Possessing the right skills is at the same time of significant importance for the individual employee’s employability and job security.
For all these reasons, the inquiry into Sweden’s Employment Protection Act (SOU 2020:30) proposes that all employers should be obliged by law to offer reasonable skills development to employees. The purpose of this essay is to analyze the employer's responsibility for skills development as a new element in Swedish labour law. This essay intends to investigate what the inquiry’s legislative proposal entails and whether it can meet the increased need for skills development that is identified in the inquiry.
The essay reaches the conclusion that the proposal is not sufficient to meet the increased need for skills development in the Swedish labour market. This is mainly due to legal technicalities, the limitations imposed by the directives and the risk that the proposal will only have a limited impact in practice. It is therefore both expected and welcomed that the proposed provision is not introduced into Swedish labour legislation. (Less) - Abstract (Swedish)
- Den svenska arbetsmarknaden genomgår strukturella förändringar i takt med den tekniska och demografiska utvecklingen. Nya kvalifikationskrav uppkommer ständigt och behovet av kompetensutveckling ökar. Tillgången till högkvalificerad arbetskraft framstår som alltmer avgörande för arbetsgivarens konkurrensförmåga. Att besitta rätt kompetens är samtidigt av betydande vikt för den enskilde arbetstagarens anställningsbarhet och anställningstrygghet.

Uppsatsen ämnar utreda vad utredningens lagförslag innebär och huruvida det kan tillgodose det ökade behovet av kompetensutveckling som identifieras i utredningen.
I uppsatsen nås slutsatsen att lagförslaget inte är tillräckligt för att möta det ökade behovet av kompetensutveckling på den svenska arbetsmarknaden. Detta beror framför allt på lagförslagets tekniska utformning, de begränsningar som följer av direktiven och risken att förslaget endast får ett begränsat genomslag i praktiken. Det är därför både väntat och välkommet att den föreslagna bestämmelsen inte införs i svensk arbetsrättslig lagstiftning. (Less)
