- Huvudsyftet med uppsatsen är att titta närmare på hur underinstanserna
tillämpar 7 § i lagen (2014: 307) om påföljder för penningtvättsbrott. 7 § ger
uttryck för kriminaliseringen av näringspenningtvätt. Den som i
näringsverksamhet, eller i ett led i en verksamhet som bedrivs vanemässigt
eller i annars i större omfattning, medverkar till en åtgärd som skäligen kan
antas vara för att dölja pengar som härrör från brottslig verksamhet döms för
näringspenningtvätt. Lagrummets utformning och ordalydelse antyder att
deltagande i objektivt misstänkta transaktioner är ett brott om det finns ett
klandervärt risktagande.

Syftet är att undersöka vilka omständigheter som ställs upp för att fastställa
att en tilltalad har tagit ett klandervärt risktagande i samband med en
transaktion. Svaret på detta kommer att erhållas genom att analysera
rättsfall. Uppsatsen diskuterar bestämmelsen ur ett
brottsbekämpningsperspektiv för att nå en slutsats om hur man kan förstå
bestämmelsen om näringspenningtvätt. Dessutom behandlar uppsatsen vem
som främst påverkas av lagstiftningen.
Uppsatsen inleds med en kort genomgång av olika teorier om
brottsprevention som individualprevention, allmänprevention,
rutinaktivitetsteorin och brottsbekämpningsmodellen. För att verkligen
förstå tankarna om förebyggande av ekonomisk brottslighet redogör
uppsatsen även för tillgångsinriktad brottsbekämpning och teorin om
manschettbrottslighet.
Uppsatsens konkluderar att det är svårt att dra allmänna riktlinjer för
bestämmelsens omfattning. Det är svårt att fastställa vilka omständigheterna
som utgör ett klandervärt risktagande. Domar från underinstanserna har
ingen prejudicerande verkan, men syftet med avhandlingen är att i
möjligaste mån fastställa vilka omständigheter som kan tala till fördel eller nackdel för en tilltalad. Omständigheterna som har talat för att den tilltalade
gjort ett klandervärt risktagande har huvudsakligen berört tre områden;
bristande trovärdighet, koppling till andra brott (främst brott relaterade till
droger, våld och vapen) och transaktionens form. Bestämmelsen ter sig
emellertid utesluta kopplingar till skatte- och bokföringsbrott.
Det finns således utrymme för att förbättra lagstiftningen i syfte att
förebygga brott, men det är viktigt att detta görs samtidigt som man klargör
vilka handlingar och åtgärder som faktiskt är kriminaliserade. Detta får inte
ske på bekostnad av rättssäkerheten. (Less) - Abstract

Swedish courts apply article 7 of the Act (2014:307) on penalties for money
laundering offences. In accordance with article 7, a person who through a
business activity that is conducted habitually, or in a greater extent,
participates in a measure that can reasonably be assumed to be conducted
for the purpose of concealing money that stem from criminal activity has
committed commercial money laundering. The articles form and wording
imply that participation in objectively suspicious transactions is an offense
if a culpable risk-taking is at hand.

participates in a measure that can reasonably be assumed to be conducted
for the purpose of concealing money that stem from criminal activity has
committed commercial money laundering. The articles form and wording
imply that participation in objectively suspicious transactions is an offense
if a culpable risk-taking is at hand.
The aim is to investigate which circumstances are crucial when establishing
if a defendant has taken a culpable risk-taking in relation to a transaction.
The answer to this will be obtained by analyzing court cases. The essay
discusses the provision from a law enforcement perspective in order to reach
a conclusion on how one can understand the provision on commercial
money laundering. Furthermore, the essay also addresses who is primarily
affected by the legislation.
The essay begins with a brief review of different crime theories on
prevention such as individual prevention, general prevention, routine
activity theory and the crime control model. In addition, to really understand
the thoughts on preventing economic crime the essay also explains assetoriented
crime prevention and the economic crime theory, white collar
crime.
The essay concludes that it is difficult to draw general guidelines regarding
the scope of the provision. The circumstances that constitute culpable risktaking are difficult to determine and ascertain. Sub-instance practice does
not have a prejudicial effect, but the purpose of the thesis is to, as far as
possible, establish which circumstances can speak to the advantage or disadvantage of a defendant. The circumstances arguing that the defendant
has made a culpable risk-taking have mainly concerned three areas; lack of
credibility, connection to other crime (mainly crimes related to drugs,
violence and guns) and the form of the transaction. However the provision
seem to exclude certain affiliation to tax- and accounting offenses.
Thus, there is room to improve the legislation with the purpose of
preventing crime but it is important that this is done while clarifying which
acts are actually criminalized. This must not be at the expense of legal
