Ansvarsfördelningen mellan köparen och säljaren vid fastighetsköp -En kritisk studie av gällande rätt och frågan om behovet av en ny reglering

För privatpersoner är ett fastighetsköp något speciellt då man endast gör denna affären någon eller några gånger i sitt liv. Köpet rör stora belopp och därför är reglerna om ansvarsfördelningen vid fel i fastighet viktiga. Tidigare ansvarade säljaren bara för vad han direkt utfäst i avtalet. Det var köparen som hade hela felansvaret oavsett om felet var dolt eller inte. Med tiden förändrades reglerna kraftigt. Säljaren fick ansvar för dolda fel oavsett om han känt till felet eller inte. För att begränsa säljarens ansvar ålades köparen en undersökningsplikt.

In days gone by, the seller was only responsible for what is explicitly stated in the convene agreement. It was the purchaser who had a complete responsibility about any defect that might show up, regardless whether that defect was hidden or evident. In order to limit the seller's liability, the buyer became in demand to investigate.

The legislator's aim with the new division of responsibilities between the buyer and the seller was to promote the balance between the real estate and the purchase price. In the essay, it will be described how strict the buyer's duty to investigate is and how the seller's information affects the buyer's investigation. Is the legislator's solution appropriate? Are there other expedient solutions? These questions will be investigated in the essay as pedagogically as possible. (Less)
