Det är viktigt att arbeta förebyggande för att förhindra att sexualbrott mot barn begås, inte minst eftersom sexualbrott kan få långtgående konsekvenser för den som blir utsatt. I Europarådets konvention om skydd för barn mot sexuell exploatering och sexuella övergrepp anges att varje part ska säkerställa eller främja effektiva förebyggande eller behandlande program eller åtgärder i syfte att förhindra eller reducera riskerna för upprepade sexualbrott mot barn. Det är viktigt att arbeta förebyggande för att förhindra att sexualbrott mot barn begås, inte minst eftersom sexualbrott kan få långtgående konsekvenser för den som blir utsatt. I Europarådets konvention om skydd för barn mot sexuell exploatering och sexuella övergrepp anges att varje part ska säkerställa eller främja effektiva förebyggande eller behandlande program eller åtgärder i syfte att förhindra eller reducera riskerna för upprepade sexualbrott mot barn. Det är dock svårt att på förhand veta vilka personer som kommer att begå sexualbrott mot barn, varför brottsförebyggande åtgärder ofta riktas mot de som redan har begått ett brott och därmed har blivit upptäckta av myndigheterna. Syftet med denna uppsats är att utreda vilka åtgärder som vidtas i straffsystemet för att förebygga att sexualbrottsdömda återfaller i sexualbrott mot barn.

I det svenska straffsystemet är det främst på verkställighetsnivån som återfallsförebyggande åtgärder vidtas. Den åtgärd som särskilt framhålls när det gäller arbetet att förebygga återfall i sexualbrott är Kriminalvårdens behandlingsprogram Sexualbrottsprogram med individuellt fokus. Behandlingsprogrammet bedrivs både i anstalt och inom frivården och syftar till att minska risken för återfall i sexualbrott. I straffsystemet kommer den återfallsförebyggande tanken dessutom genomgående till uttryck. Verkställigheten av ett fängelsestraff ska till exempel i den mån det är möjligt särskilt inriktas på åtgärder som är ägnade att förebygga återfall i brott. Villkorlig frigivning kan skjutas upp om den dömde under anstaltstiden inte deltar i, eller missköter, återfallsförebyggande åtgärder. Behandlingstanken kan därför sägas ha en central roll i det svenska straffsystemet. Straffsystemet syftar till att förebygga återfall i brott genom bland annat behandling, även om så inte alltid blir resultatet. Det är inte klarlagt i vilken utsträckning deltagande i behandlingsprogram är effektivt för att minska återfallsrisken hos sexualbrottsförövare. Ytterligare forskning krävs på området. (Less)

Preventing sexual crimes against children is of great importance, not least due to the far-reaching consequences that sexual crimes can lead to for those who are exposed. The Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse states that each party shall ensure or promote effective intervention programmes or measures with a view to preventing and minimizing the risks of repeated offenses of a sexual nature against children. However, the difficulty in identifying which individuals who will commit sexual crimes against children entails that the crime prevention measures are often directed at those who already have committed a crime and thus are known by the authorities. Preventing sexual crimes against children is of great importance, not least due to the far-reaching consequences that sexual crimes can lead to for those who are exposed. The Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse states that each party shall ensure or promote effective intervention programmes or measures with a view to preventing and minimizing the risks of repeated offenses of a sexual nature against children. However, the difficulty in identifying which individuals who will commit sexual crimes against children entails that the crime prevention measures are often directed at those who already have committed a crime and thus are known by the authorities. The purpose of this thesis is to investigate what measures are taken in the penal system to prevent convicts of sexual offenses from relapse into sexual offenses against children.

In the Swedish penal system, it is mainly at the enforcement level that recidivism prevention measures are taken. The measure that is particularly emphasized is the Swedish Prison and Probation Service's treatment program Sexual Offenses Program with an individual focus. The treatment program is conducted both in institutions and in probation and aims to reduce the risk of recidivism. In the penal system, the recidivism prevention idea is also consistently expressed. The execution of a prison sentence shall, for example, as far as possible, be specifically focused on measures that are suitable for preventing recidivism. Conditional release can be postponed if the convicted person during the imprisonment period does not participate in, or mismanages, relapse prevention measures. The idea of treatment can therefore be said to have a central role in the Swedish penal system. The penal system aims to prevent recidivism through, among other things, treatment, even if this is not always the result. It is not clear to what extent participation in treatment programs is effective in reducing the risk of recidivism among sex offenders. Further research is needed. (Less)
