- Fördrag om Principer för Staternas Verksamhet vid Utforskning och Användning av Yttre Rymden, inklusive Månen och andra Himmelska Kroppar, infördes 1964. Sedan 1985 har inget nytt rymdtraktat introducerats. Rymden har sedan dess förändrats. På grund av detta, finns det många problem i rymden idag som inte förutsågs vid introduktionen av rymdtraktaten. Rymdskrot är ett av problemen som inte förutsågs. Om rymdskrot med 1 cm i diameter krockar med ett objekt, kan det ha samma effekt som en missil. Detta har resulterat i att rymdaktörer har utvecklat flera olika dyra metoder för att undvika kollisioner med rymdskrot. I dagsläget finns det ingen bindande definition av rymdskrot, eller bindande rymdskrotregler.

Denna kandidatuppsats utvärderar vilka juridiska konsekvenser skapandet av rymdskrot kan innebära. Trots bristen av bindande rymdskrotsregler, verkar det möjligt genom vägledning av traktatstolkning och juridisk doktrin att internationella rymdtraktat och internationella juridiska principer kan reglera skapandet av rymdskrot. Doktrinen antyder att skapande av rymdskrot kan medföra en skyldighet att registrera rymdskrotet man skapar och ansvar. Ytterligare kan skapande av rymdskrot ses som en kränkning av rymdens status som res communi, och miljöregler. För att veta hur rymdskrot ska juridiskt regleras krävs det ny traktaträtt, internationell sedvanerätt, eller praxis. (Less) - Abstract

- The Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies (Outer Space Treaty) was introduced in 1967. Although the area of space has widely changed since then, no new binding space treaties have been introduced since 1984. Consequently, the current legislation is not adapted to the many of the current space problems. One of the major issues today concerns the creation of space debris. Space debris with the diameter of 1 cm has the potential to have same impact as a missile if it were to crash into an object in outer space. Therefore, space actors have several different expensive methods to avoid being hit by space debris. At present time, there is no recognized definition of space debris nor explicit binding regulation regarding space debris.
This is essay evaluates what the legal implications for the creation of space debris could be. Despite the lack of binding regulations regarding space debris, it seems possible through treaty interpretation supported by legal doctrine that principles of international law, and international space treaties shall be applicable to the issue of the creation of space debris. Legal doctrine implies that seems possible that the creation of space debris can invoke responsibilities of registration, and liability. Additionally, the creation of space debris be seen as a violation of outer space as a res communi, and of environmental regulation. In order to support this claim fully, there is a need for new binding legislation, established international customary law, or case praxis. (Less)
