Straffmätning - livstids fängelse vid mord - En komparativ undersökning av Danmark och Sverige.

Den här uppsatsens syfte är att reda ut och redogöra för hur straffmätningen kring livsstraffet vid mord går till i Sverige och Danmark. Uppsatsen har skrivits ur ett komparativt synsätt i syfte att jämföra länderna och således också analysera likheter och skillnader.
Livstidsstraff kan i teorin dömas ut för ett antal grova brott i både Danmark och Sverige men döms i praktiken nästan enbart ut i fall av mord, därav har en avgränsning gjorts kring att enbart fokusera på brottet mord.
Livstidsstraffet är ett icke-tidsbestämt straff som i teorin skulle kunna innebära en hel livstid. I praktiken ser det dock inte ut så, mellan åren 2005-2013 var 25 år den genomsnittliga strafftiden för svenska livstidsfångar. I Danmark är teorin densamma,... (More)

Livstidsstraffet är ett icke-tidsbestämt straff som i teorin skulle kunna innebära en hel livstid. I praktiken ser det dock inte ut så, mellan åren 2005-2013 var 25 år den genomsnittliga strafftiden för svenska livstidsfångar. I Danmark är teorin densamma, en person skulle kunna sitta inne en hel livstid men sitter i praktiken i genomsnitt inne i 17 år. En annan skillnad är att man i Danmark kan dömas till något som kallas førvaring, detta är i teorin ett icke-tidsbestämt straff för de brottslingar som anses vara särskilt farliga för sin omgivning.
Genomsnittstiden att sitta inlåst för personer dömda till førvaring är cirka 14,5 år.
I Sverige kan man dömas till rättspsykiatrisk vård i stället för fängelse om personen i fråga bedöms lida av en allvarlig psykisk störning. Rättspsykiatrisk vård är inte heller ett tidsbestämt straff utan vårdbehovet avgör längden på vården.
Även kravet på tillräknelighet och vilken roll detta spelar i Danmark och Sverige behandlas för att slutligen diskutera de gällande bestraffningsteorier som lägger grunden för ländernas rättssystem. (Less)

The aim of this essay is to untangle and explain the meting out of punishment-process regarding the life imprisonment sentence for murder in Sweden and Denmark. The essay is written mainly from a comparative standpoint to enable analyzing similarities and differences between the countries. Life imprisonment is statutory for a number of crimes, however it is almost exclusively applied to murder cases. Therefore a demarcation has been made in this essay to solely focus on the crime of murder.

The aim of this essay is to untangle and explain the meting out of punishment-process regarding the life imprisonment sentence for murder in Sweden and Denmark. The essay is written mainly from a comparative standpoint to enable analyzing similarities and differences between the countries. Life imprisonment is statutory for a number of crimes, however it is almost exclusively applied to murder cases. Therefore a demarcation has been made in this essay to solely focus on the crime of murder.
Life imprisonment is in theory a time-indetermined sentence in both Sweden and Denmark. However in practice the people sentenced to life imprisonment serve a far shorter punishment. On average the life imprisonment inmates in Sweden serve 25 years and in Denmark 17 years. Another difference between the countries is that Denmark has an additional time indetermined sentence called Storage (Førvaring). It is meant for the criminals deemed to be particularly dangerous for their surroundings. The average time in jail for inmates sentenced to Storage is 14.5 years.
In Sweden Storage (Førvaring) is not an available sentence, the closest thing would be forensic psychiatric care. Inmates can be sentenced to forensic psychiatric care instead of prison when deemed to be suffering from serious mental illness. Forensic psychiatric care is also a time-indetermined punishment, it is the need for care of the individual that decides the duration of the care.
Furthermore the rules regarding sanity and the part it plays in the Danish and Swedish justice systems will be analyzed and finally the applicable theories of punishment that lay the foundation for the criminal justice system will be discussed. (Less)
