- Att skyddas från diskriminering är en mänsklig rättighet. Det gäller såväl i arbetslivet som i andra samhällsområden. Diskriminering kan ske på olika sätt, hänfört till olika diskrimineringsgrunder. Diskriminering som sker på grund av flera grunder kallas för multipel diskriminering. Den nationella lagstiftningen reglerar inte multipel diskriminering vilket har kritiserats på flera håll. En särskilt utsatt grupp i detta avseende är kvinnor med etnisk och religiös minioritetsbakgrund.
Syftet med studien är att undersöka om och i så fall hur dessa kvinnor skyddas från multipel diskriminering i arbetslivet. För att göra det undersöks och analyseras såväl Arbetsdomstolens rättspraxis på området som den bakomliggande diskrimineringsrätten.... Genom den rättsliga utredningen identifieras olika områden där det finns ett behov av förbättring av diskrimineringsskyddet. Diskrimineringslagen uttrycker inte något skydd vid multipel diskriminering. Däremot nämns detta i förarbeten och behandlas delvis i praxis. Ur ett intersektionellt perspektiv är dock skyddet för multipel diskriminering otillräckligt. Sammantaget har det påvisats att det finns brister i det skydd som ges till dessa kvinnor. Through the legal investigation, various areas are identified where there is a need to improve discrimination protection. The Discrimination Act does not express any protection in case of multiple discrimination. On the other hand, this is mentioned in preparatory work and is partly dealt with in practice. From an intersectional perspective protection against multiple discrimination is insufficient. Overall, it has been shown that there are deficiencies in the protection given to these women. (Less)
