- Under år 2022 vräktes totalt 575 barn i Sverige enligt statistik från Krono-fogden, detta trots att en nollvision mot vräkningar av barnfamiljer infördes år 2008 av den dåvarande alliansregeringen och att Förenta nationernas kon-vention om barnets rättigheter artikel 1–42 införts som lag i Sverige. Hur ska detta faktum förklaras och förstås?
Uppsatsen ämnar utreda hur principen om barnets bästa enligt artikel 3.1 barnkonventionen ska tolkas och tillämpas vid bedömningar enligt 46 § första stycket 2 hyreslagen. Genom en undersökning av Barnrättskommit-téns allmänna kommentar nummer 14 och Svea hovrätts praxis har uppsatsen visat att Svea hovrätts och Barnrättskommitténs synsätt av artikel 3.1 barn-konventionen skiljer sig åt och att... - According to statistics from the Swedish Enforcement Authority a total of 575 children were evicted in Sweden during the year of 2022, even though a policy of a zero-tolerance against the eviction of families has been imple-mented by the government and the United Nations Convention on the Rights of the Child has been incorporated into domestic law.
The essay intends to analyze how the principle of the best interest of the child, as stated in Article 3.1 of the Convention on the Rights of the Child should be interpreted and applied in questions regarding tenancy disputes.
Through the study of court practice from the Svea Court of Appeal and the Committee on the Rights of the Children’s General Comment No. 14 the essays concludes that...
