- På Svenska kyrkans senaste kyrkomöte lades två motioner fram kring att be- gränsa prästers rätt att vägra viga samkönade par. Det aktualiserade frågan om det för ett trossamfund är möjligt att begränsa vigselrätten för vigselför- rättare inom samfundet. Vigselrätten stadgas i 4 kap. 3 § ÄktB och i 4 kap. 3 § 2 st. ÄktB beskrivs att präster eller andra befattningshavare i trossamfund inte har någon vigselplikt. Det föranleder en fråga om varför utformningen av 4 kap. 3 § ÄktB ser ut som den gör, bland annat att vigsel inom trossam- fund regleras i första hand och borgerlig vigsel i andra. Gällande rätt diskuteras utifrån principen om statens neutralitet i frågor som rör trossam- fund, faktumet att lagtext ska vara förutsägbar samt att undantag gällande myndighetsutövning ska regleras i lag. Slutsatsen dras att vigselrätten för präster eller andra befattningshavare kan begränsas av samfundet självt då samfunden har rätt att införa interna regler. (Less)

- At the Church of Sweden's most recent church meeting, two motions were discussed regarding limiting priests' right to refuse to officiate weddings be- tween same-sex couples. It emphasized the question of whether it is possible for a religious community to limit a priest’s right to officiate weddings within the community. In the analysis, the discussion centers around the fact that ch. 4. § 3 ÄktB is based on two strong motives; histori- cal factors and a clarification of applicable law. Applicable law is discussed regarding the principle of the state's neutrality in matters relating to religious communities, the fact that legal text must be predictable and that exceptions regarding the exercise of authority must be regulated by law. The conclu- sion is that the right to officiate for priests or other officials can be limited by the community itself as the religious communities have the right to intro- duce internal rules. (Less)
