- För att generalklausulen i den svenska lagstiftningen mot skatteflykt ska kunna tillämpas krävs det att skatteförmånen som uppstår strider mot lagstiftningens syfte. Vad detta innebär är inte fullständigt klarlagt av vare sig lagstiftaren eller av Högsta förvaltningsdomstolen. Lagens syftar till att domstolen ska göra en analog tolkning och dess rättssäkerhet har därför varit omdiskuterad. Syftet med denna uppsats är att analysera när Lag (1995:575) mot skatteflykt tillämpas och undersöka lagens förenlighet med legalitetsprincipen.
Legalitetsprincipen anses vara en framträdande princip inom skatterätten för att säkerställa rättssäkerheten. Principen, och därtill rättssäkerheten, vägs mot lagstiftningens effektivitet och resultat. Avvägningen från lagstiftaren leder till att lagen i stora delar inte är förenlig med flera av legalitetsprincipens delområden, i synnerhet analogiförbudet och kravet på bestämdhet. Denna osäkerhet kan minskas genom vägledning från praxis. I uppsatsen analyseras praxis från Högsta förvaltningsdomstolen för att uttyda generella principer för lagens tillämpning. Slutsatsen utmynnar i att det genom praxis går att uttyda generella principer för skatteflyktslagens tillämpning när det gäller vissa skatterättsliga förfaranden. (Less) - Abstract

The law aims for the court to make an analogous interpretation and its legal certainty has therefore been debated. The purpose of this essay is to analyze when the Law (1995:575) against tax evasion is applied and examine the law's compatibility with the principle of legality.
The principle of legality is considered a prominent principle in tax law to ensure legal certainty. The principle is weighed against the legislation's effectiveness. The law is largely incompatible with several of the sub-areas of the principle of legality, in particular the prohibition of analogy and the requirement for definiteness. This uncertainty can be reduced by guidance from practice. The practice of the Supreme Administrative Court is analyzed to express general principles for the application of the law. The conclusion culminates in the fact that, through practice, it is possible to define general principles for the application of the Tax Avoidance Act in relation to certain tax procedures. (Less)
