- Uppsatsen syftar till att undersöka lagstiftarens möjligheter att begränsa papperslösa barns rätt till utbildning och möjligheten att införa en informationsplikt mellan svensk skola och migrationsmyndigheter, samt hur en eventuell informationsplikt kan påverka papperslösa barns rätt till utbildning. Med beaktande av det pågående arbetet med Tidöpartiernas förslag granskar uppsatsen de möjligheter och begränsningar som lagstiftaren står inför när det gäller att reglera papperslösa barns rätt till utbildning.
Papperslösa barn i Sverige omfattas inte av den skolplikt som gäller för folkbokförda barn, vilket innebär att de saknar en grundlagsskyddad rätt till utbildning. Papperslösa barn i Sverige omfattas inte av den skolplikt som gäller för folkbokförda barn, vilket innebär att de saknar en grundlagsskyddad rätt till utbildning. Trots detta har Sverige, genom nationell lagstiftning, tilldelat papperslösa barn rätt till utbildning i form av förskoleklass, grundskola, grundsärskola, specialskola, sameskola, samt gymnasieskola och gymnasiesärskola, under förutsättning att utbildningen påbörjas innan barnet fyller 18 år. Rätten till utbildning för papperslösa barn är förankrad både i svensk lagstiftning och i internationella överenskommelser som barnkonventionen och EKMR.
Uppsatsen identifierar att både möjligheten för lagstiftaren att begränsa rätten till utbildning och ett eventuellt införande av en informationsplikt kan anses strida mot barnkonventionen, vilket skapar en utmaning för lagstiftaren att avväga olika intressen och säkerställa det skyddet av papperslösa barns rättigheter. Samtidigt understryker uppsatsen osäkerheten kring huruvida en informationsplikt skulle kunna komma att utformas och hur lagstiftaren kommer att bedöma papperslösa barns rätt till utbildning i förhållande till intresset av ett effektivt återvändandearbete för de som vistas i landet utan tillstånd. - The purpose of this essay is to examine the legislator's possibilities to restrict the right to education for undocumented children and the potential introduction of an information duty between Swedish schools and immigration authorities. Additionally, it explores how such an information duty might impact the educational rights of undocumented children. Considering the ongoing work with the proposal from the Tidö parties, the essay investigates the opportunities and limitations faced by the legislator in regulating the educational rights of undocumented children.

Undocumented children in Sweden are not subject to the compulsory education that applies to registered children, resulting in a lack of a constitutionally protected right to education. Nevertheless, Sweden, through national legislation, has granted undocumented children the right to education, encompassing preschool, compulsory school, compulsory special school, special school, Sami school, as well as upper secondary school and upper secondary special school, provided that the education begins before the child turns 18. The right to education for undocumented children is anchored both in Swedish legislation and in international agreements such as the Convention on the Rights of the Child (CRC) and the European Convention on Human Rights (ECHR).
The essay identifies that both the legislator's ability to restrict the right to education and a potential introduction of an information duty may be considered in conflict with the CRC, posing a challenge for the legislator to balance various interests and ensure the protection of the educational rights of undocumented children. Simultaneously, the essay emphasizes the uncertainty regarding how an information duty might be formulated and how the legislator will assess the right to education for undocumented children in relation to the interest in effective return efforts for those residing residing in the country without authorization.
