Kostnadsändring i entreprenadavtal enligt AB 04 6 § 3

Abstract
In recent years, the world has faced several tough challenges, and the Swedish
construction industry is of course no exception. The effects of the pandemic
caused problems in many construction projects and contractual relationships.
When the pandemic seemed to be subsiding, Russia invaded Ukraine and the
next ordeal was a fact.
We live in a global world where war also has an impact outside the war-torn
area. The consequences of the war are sharply increased prices for raw materials, energy and fuel, all of which have had a major impact on both ongoing
contracts and contracts under procurement.

In recent years, the world has faced several tough challenges, and the Swedish
construction industry is of course no exception. The effects of the pandemic
caused problems in many construction projects and contractual relationships.
When the pandemic seemed to be subsiding, Russia invaded Ukraine and the
next ordeal was a fact.
We live in a global world where war also has an impact outside the war-torn
area. The consequences of the war are sharply increased prices for raw materials, energy and fuel, all of which have had a major impact on both ongoing
contracts and contracts under procurement.
The prerequisite for a change in the agreed price is that the change in costs
must have been both unforeseeable and that it has significantly affected the
entire cost of the contract. An unforeseeable cost means that the contractor
was not aware of the circumstances that led to the change in cost at the time
of submitting the tender.
As regards the question of who should bear the cost of cost changes, the general rule is that the risk of price changes always falls on the party affected by
them. AB 04/ABT 6 § 3 is a provision that has historically rarely had to be
used, but which under certain conditions can impose costs on the client instead of the contractor.
In long-term construction projects, it is not uncommon for large costs to be
involved. Due to the current situation in the world in recent years, it may be
a recommendation to regulate the right to price change in the contract through
indexation. This creates predictability for the parties and avoids the risk of a

De senaste åren har omvärlden stått inför flera tuffa utmaningar och den svenska byggbranschen är förstås inget undantag. Pandemins effekter ställde till det i många byggprojekt och avtalsrelationer. När pandemin till synes ver-kade klinga av, gick Ryssland in i Ukraina och nästa prövning var ett faktum.
Vi lever i en global värld där krig får verkningar även utanför det krigsdrab-bade området. Konsekvenserna av kriget är kraftigt ökade priser på råmaterial, energi och drivmedel som samtliga haft stor påverkan på såväl pågående ent-reprenader som entreprenader under upphandling.

En oförutsebar kostnad innebär att entreprenören vid an-budsgivandet inte haft kännedom gällande omständigheterna som föranledde kostnadsändringen.
Vad gäller frågan om vem som ska bära kostnaden för kostnadsändringar är huvudregeln att risken för prisförändringar alltid faller på den part som drab-bas av sådana. AB 04/ABT 6 § 3 är en bestämmelse som historiskt sällan behövts användas men som under vissa förutsättningar kan påföra kostnader på beställaren i stället för entreprenören.
I långvariga entreprenadprojekt handlar det inte sällan om stora kostnader. Med anledning av det rådande läget i omvärlden de senaste åren kan det vara en rekommendation att reglera rätt till prisförändring i avtalet genom indexre-glering. Detta skapar förutsebarhet för parterna och risken för att man hamnar i tvist kan undvikas. (Less)
