Förordningsförslaget “AIA” - Kommissionens förslag till AI-förordningen i relation till AI-genererad marknadsföring

- Abstract
- We live in a world where artificial intelligence is not beyond reach in science fiction-movies, but rather a part of our daily life. The technology is drastically developing and the world of law cannot follow. Due to the big impact that artificial intelligence has on EU citizens, and the risks that may threaten, there is an ongoing procedure regarding harmonized rules on AI.
The initiative has a purpose of battling with problems that the technology entails, for example threat against the citizens fundamental rights, but also to make sure the AI developed is compatible with existing EU legislation and values. The European commission also shows interest in fostering innovation and thereby becoming a leading force in regards to... There has been some critique expressed towards the proposal from the commission. Affected parties have communicated a concern for the proposal not fulfilling its purpose and being incomplete. Mainly because of the fact that the scope is not clearly identified.
AI is used in many industries in the european market, most of the companies use AI-generated marketing. In the last few years, deepfakes have become a widespread phenomena, specifically in forms of AI-generated influencers. This can jeopardize the fundamental rights of the EU citizens. Because of the fact that the usage of AI in marketing is huge it's highly relevant to examine how the AI act might be applicable on AI-marketing. (Less) - Abstract (Swedish)

Det har framförts ganska mycket kritik mot kommissionens förslag till rättsakten, påverkade aktörer menar på att det inte uppfyller sitt syfte, och att den är ofullständig. Främst eftersom tillämpningsområdet av förordningen inte är tydligt.
AI används i flera branscher på den inre marknaden, bland annat använder merparten av företagen AI-genererad marknadsföring. Under senare år har även deepfakes börjats användas i influencermarkandsföring, vilket kan leda till att de grundläggande rättigheterna äventyras. Eftersom att användningsområdet är så stort blir det relevant att förstå hur förordningen evetuellt kan komma att bli tillämplig på AI-marknadsföring. (Less)
