- Denna uppsats undersöker hur barns rätt att höras beaktas i samband med upphörande av vård enligt lag (1990:52) med särskilda bestämmelser om vård av unga (LVU). Den behandlar även gällande rätt vad avser tvångsvårdens genomförande när ett barn eller en ung person omhändertas för vård. Fokus ligger på barnets delaktighet i utredningar utifrån principen om barnets bästa, samt på vårdens utformning i förhållande till föräldrars möjlighet att medverka och vara delaktiga vid genomförandet av vården.
Genom studier av rättspraxis, barns och ungas delaktighet och inflytande i tidigare, respektive nuvarande rättstillämpning, visar uppsatsen att det finns strukturella brister som ställer till problem för rättstillämparen att beakta barnets bästa... Den behandlar även gällande rätt vad avser tvångsvårdens genomförande när ett barn eller en ung person omhändertas för vård. Genom studier av rättspraxis, barns och ungas delaktighet och inflytande i tidigare, respektive nuvarande rättstillämpning, visar uppsatsen att det finns strukturella brister som ställer till problem för rättstillämparen att beakta barnets bästa och hantera intressekonflikter. Den bristande genomslagskraften för barnrättsperspektivet i lagstiftningen indikerar ett behov av översyn i syfte att bättre harmonisera med Barnkonventionen och skydda barn som riskerar att råka illa ut. - This thesis examines how children's right to be heard is considered in the context of the termination of care under the Care of Young Persons (Special Provisions) Act (1990:52) (LVU). It also addresses the current legal framework regarding implementing compulsory care when a child or young person is taken into custody. The focus is on the child's participation in investigations based on the principle of the best interests of the child, as well as on the design of care concerning parents' opportunities to participate and be involved in the implementation of the care.
Through the study of case law and the participation and influence of children and young people in both past and current legal practice, the thesis reveals structural... (More) - This thesis examines how children's right to be heard is considered in the context of the termination of care under the Care of Young Persons (Special Provisions) Act (1990:52) (LVU). It also addresses the current legal framework regarding implementing compulsory care when a child or young person is taken into custody. The focus is on the child's participation in investigations based on the principle of the best interests of the child, as well as on the design of care concerning parents' opportunities to participate and be involved in the implementation of the care.
Through the study of case law and the participation and influence of children and young people in both past and current legal practice, the thesis reveals structural deficiencies that complicate the ability of legal practitioners to consider the child's best interests and manage conflicts of interest. The lack of efficacy of the child rights perspective in legislation indicates a need for review to better align with the UN Convention on the Rights of the Child and to protect children who are at risk of harm.
